Legal Tidbit for the day... its important for advocates to be informed of the law when calling the appropriate authorities. When there is a case pending, and we want to keep the abuser from owning animals, THIS is the most important section of law there is. It is actually better than a registry, but is not known about and not used. Advocates must strongly request that Ag+ Markets 374-8c be a part of any plea/sentence. The DA and/or Judge MUST be advised by advocates to mandate that Ag + Markets 374-8c be made a part of any plea/sentence. That section is very impt., and DAs and Judges dont know about it. It reads as follows.... c. The court may additionally order that the convicted person or any person dwelling in the same household who conspired, aided or abetted in the unlawful act which was the basis of the conviction, or who knew or should have known of the unlawful act, shall not own, harbor, or have custody or control of ANY other animals, other than farm animals, for a period of time which the court deems reasonable. As a DA prosecuting animal crimes, I made this a part of ANY sentence. Further, I added a term that the defendants must submit to check ups by local authorities to ensure compliance. If someone was in violation, which often happened, they would be locked up for criminal contempt for disobeying a lawful judicial mandate. There is not a single better way for law enforcement to keep animals out of the hands of abusers.
