Let it be put on the record that in this instance justice has been served. An Bord Pleanala have issued their decision in relation to the Appeal Lodged by the Kildare and Wicklow Education and Training Board concerning the Financial Contribution of €726,480 imposed by Kildare Co. Council when granting planning permission for the Two New Secondary Schools for Maynooth on the Moyglare Road. Kildare Co. Council had imposed the financial contribution to cover the cost of the purchase of additional land and the provision of footpath and cycle infrastructure improvements on the Moyglare Road between the site for the school and the Town Centre. An Bord Pleanala have removed the condition for the following reason: The Board is satisfied that the proposed development is to be carried out on behalf of a voluntary body and is intended to be used for educational purposes and is not for profit or gain. Having regard to the specific objective contained in the current Maynooth Local Area Development Plan to upgrade and improve pedestrian and cycling facilities along the Moyglare Road, it is considered that such works would be covered under the adopted Kildare County Council Development Contribution Scheme. The works in question do not, therefore, constitute specific exceptional costs which are not covered by the Scheme, as required under the provisions of section 48(2)(c).
