Meadows Eleventh District, North Carolina 1516 Longworth Office Building (202) 225-6401 September 3, 2014 Mr. Jeffrey DAuria 93 Foxden Dr Fletcher, NC 28732-5650 Dear Mr. DAuria: Thank you for contacting me with your concerns regarding President Obama’s policies and the impeachment process. As your representative in Washington, I want to ensure that your opinion is heard and appreciate that you took the time to write to me. As you know, many of President Obama’s radically progressive policies have diminished our freedom, weakened our national defense, and accelerated the growth of our debt. I am aware that many in this country believe that his actions warrant an initiation of the impeachment process. This process provides a mechanism for removal of the President, Vice President, and other federal civil officers found to have engaged in treason, bribery, or other high crimes and misdemeanors. While impeachment is a legal option for addressing abuses of power by the Executive Branch, practically speaking, any impeachment process started in the House of Representatives would not pass the Democrat-controlled Senate. Formally, impeachment proceedings cannot be filed by any individual Member of Congress, but must pass the Judiciary Committee and brought to the floor by House Leadership. Regardless, as long as Senate Majority Leader Harry Reid (D-NV) is foreman of the jury that would try President Obama, any impeachment efforts in the House will be unsuccessful. Additionally, I am not aware of any efforts to initiate impeachment proceedings. It is up to Congress and the federal courts to check the president’s overreach and restore balance to our system of government. President Obama’s far-reaching claims of executive power, if left unchecked, will vest this and future presidents with broad domestic policy authority that the Constitution does not grant. I am committed to working on your behalf to hold the President accountable and maintain the Constitutional balance of power between Congress and the President. Again, thank you for taking the time to contact me. If you have any additional concerns you would like to discuss with a member of my staff, you are welcome to call my Washington D.C. office at (202) 225-6401.
