No Bribe – No Promotion Even Selection The Hon,able Supreme Court’s ruling “ Nothing Moves without money is correct because any poor and honest person can’t get due justice due to which I am being Vicamized for long period and I am not being granted even pay sacle of Distt Treasury Officers post from 17.2.89 i.e from the date of illegal prom of Sh P.S Baweja SAS pass T.O of Gen Category junior to me promoted illegally against 25% prom quota for SAS pass T.Os Violating reservation policy under which S/c promoted recruited on the basis of his seniority / merit is to be treated as general candidate and 1st point in each quota is to be filled only by S/C and two S/Cs were to be promoted against 1st and 7th point in 1st 7 points of 25% prom quota and Rule- ( C ) of PF & AS (Class-B) Rule-1979 under which non SAS T.O ( Gen or S/C whose turn comes ) can also get prom against 25% prom quota if any SAS pass T.O ( Gen or S/C) is not available in the Cadre of T.Os . 2 . According to the formula shown at Page-230-31 of Noting besides S/Cs promoted / recruited on the basis of their seniority / merit ,there must always be 4 S/Cs (1+1+2) in 14 ( 3.5+3.5+7) 16 ( 4+4+8) posts of DTOs (Class-B) from 4.5.74 and 5 S/Cs (2+1+2) in 20 (5+5+10) posts but only retained only two S/Cs i.e one Dir (25%)and one promotee (25+50%) or both promotees since 4.5.74 one from 13.7.90 to 3.2.91 ) Besides huge shortage of S/Cs in the Cadres of DTOs (Class-B) and DCF ( Class-A) there were 6 points (3+1+2) in backlog in the Cadre of DTOs and 9 in DCF before and after 30.6.89 which were never filled . 3 . As I joined as T.O in 28.5.81 ,I could have been got 1st prom as DTO even before 27.5.87 i.e before the completion of six years exp as T.O in the light of reservation policy and supreme Court’s ruling dt 29.8.1988 ( Write No.1003-05 of 1984) but I was never promoted till my retirement on 31.10.2002 nor granted pay scale of DTos from due date or late from 17.2.89 i.e prom of Sh P.S Baweja T.O of Gen Category junior to me due to which I petitioned on 26.5.90 and copy to Governor of Pb & Secy W.D PB etc . 4 . Now as 13 only SAS pass junior T.Os of Gen Category including Sh P.S Baweja were illegally promoted against 25% Prom quota for SAS pass T.Os Violating reservation policy under which two S/Cs ( SAS pass or Non SAS ) were to be promoted i.e one against 1st from 4.5.74 and other against 7th but they never promoted and Rule-9 ( C ) of PF & AS (Class-B) Rule-1979 under which Non SAS T.O ( Gen or S/Cs) whose turn comes )can also get prom if any SAS pass ( Gen or S/C ) is not available in the Cadre of T.Os . So I sought due pay scale of post for me and all other senior superseded T.Os from the dates of illegal promotion s of 13 Junior SAS pass T.Os of General Category promoted illegally Violating the reservation policy ,Rule-9 (C) ,Human Rights of S/Cs & W.D Pb’s letter dt 3.9.64 . 5 . Under Rule 5.45 the Govt residential accommodation in of two Class i.e (1) Rented ( Out of Office premises ) and (2) Rent free ( in Office premises) . House rent of allottes of rented quarters is deductable and creditable in PWD’s Head of A/C-0216 but due House Rent of SDMs, DCs and Divisional Commissioners residing in rented Govt quarters earmarked for them under Rule-21 is not being wrongly deducted in 20 Distt out of 22 Distt by the responsible SDMs & DCs etc even after Clarification given by C.S Pb and FCR . Vide their letters dt 6.8.86 ( See in Manual Instructions ) and 4.12.2009 while due H.R of all Distt Transport Officers and all SDMs & DCs posted at Chandigarh , SAS Nagar and Amritsar is being correctly deducted under rule 5.29 ( b ) of PB CSR due to while Govt Exchequre has lost more than three crore till date and more than One Lac every month FCR Pb refused vide his letter dt 20.7.2010 to issue directions to them to implement Govt letter dt 6.8.86 because also did not deduct his due H.R when he was SDM and DC etc like C.S Pb who also did not do so (2) Rent fre quarters were constructed in Raj Bhawan ,Hospitals ,Tehsil Complexs ,Police Lines etc with the funds allotted by the concerned Deptts under the Head of A/C -4059 but not PWD under head of A/C -4216 . In Tehsil Complexs created after 1970 . 10/8 rent free quarters were construed at Tehsil level for SDM, T.O ,Tehsildars ,Naib-Tehsildars and their peons and 8/6 at Sub-Tehsil level for T.Os , N.T and their peons H.R of SDMs T.Os ,tehsildars ,Naib-Tehsildars and their peons residing only in Tehsil Complexs is not deductable under rule due to which H.R of SDMs , Tehsildars ,N.T and their peons is not being deducted in whole state and H.R of T.Os and their peons is not being deducted correctly in Patiala and after Distts but H,R of some T.Os and their peons is being wrongly deducted in Jall and some other Distts because post of T.O is not mentioned in App-7 of Pb CSR Vol-I Part-I ( print-1959) like SDMs Post of T.O was not added in the incomplete list of App-7 like SDM post because both posts were created after 1959 and rent free quarters were constructed for them in Tehsil Complexs after 1970 after which both posts were to be added in App-7 but are not being added knowingly despite my requests since 1995 to C.S Pb ,FCR ,PSF PB etc and order given by the Ex-Revenue Minister Pb on 9.5.2013 to FCR Pb and undue rent recovery of T.Os & their peons was not stopped even after repeated Orders / Clarifications given by Revenue Minister ,SDM Nakodar, DC Kapurthala,Div Commissioner Jall after receiving my petition through NHRC ,DTO Patiala ,Executive Eng PB Kapurthala Estate Oficer PWD PB Patiala . As H.R of said T.Os and their peons is not deductable under rule like in case of SDM Nakodar and others and their amount is refunded . My amount deducted wrongly and illegally through undue recovery of H.R from 10/82 is also refundable because I was provided rent free quarter in Tehsil Complex at Nakodar but is not being refundable . I am being harassed and victimized since 10/82 with the Active help of Anti-Dalits and most corrupt Officers of Various Deptts including Welfare Deptt who did not help me since 26.5.90 but now decided to take stern action against erring officials who violate reservation policy but it will only on papers like my case still pending . 6 . As I am being harassed and Victamised since 10/82 instead of opening my “Sealed Cover” kept pending since 25.8.95 and granting me and other all senior superseded T.Os more than 50 due Pay Scale of DTO’s post from the date of illegal promotion of 13 Junior SAS pass T.Os only of Gen Category ( including Sh P.S Baweja junior to me )promoted illegally against 25% prom Quota for SAS pass T.O violating reservation policy and Rule-9 ( C ) (2) due pay scale of DCF ( Class-A) post from the due dates (3)Supplying me attested photo copy of incorrect and corrected Roster Register of DTO (Class-B)and R.R of DCF Corrected from 4.5.74 on the basis of quotas fixed for DTO’s 25% & from 13.8.85 20% and 75/80% for ACF’s and after treating prom of Sh P.C Suman (S/C) DTO from 4.5.74 against R.P 1st reserved for S/Cs from DTO but promoted against R.P -20 from 3.12.76 ( very late) . (4) Stopping undue rent recovery of H.R of T.Os and their peons residing only in rent free quarters in Tehsil Complexs like SDM ,Tehsildars ,Naib-Tehsildars and their peons under rule and refunding their amount deducted wrongly and credited in PWD’s Head of A/C-0216 alongwith 20% Intt from due dates and (5) starting the due rent recovery from the responsible SDMs and DCs and Divisional Commissioners residing in rented Govt Quarters ( out of Tehsil Complexs) like Distt Transport Officers and other SDMs, DCs etc posted at Chandigarh ,SAS Nagar and Amritsar and recover amount of arear for the previous period . 7 . I made so many petitions to PM including five petitions forwarded merely to C.S Pb by PMO vide letter dt 19.7.2007 and one on 12.5.98 by Sh I.K Guzral and one by SH Narinder Modi instead of date bound stern directions for redressing our grievances without further delay . we are not being helped by authorities in state & Centre including Governor of PB , PB State S/Cs Commission , NC for S/Cs, Rashtarpati , PM .I made so many complaints to PB V.D, V.B , CBI and CVC, PPSC, UPSC , DOPT Officials of these agencies are also shielding to the Anti-Dalits and most corrupt Officers / Officials and their helpers . I sent my petition dt 5.2.2004 alongwith copy of News-item “ Retiree Threaten to Commit Suicide “published in the Tribune on 23.11.2003 / 16.12.2003 which was forwarded vide letter dt 17.2.2004 wrongly to DGP ( C ) PB by the Officials of the Hon,able Supreme Court simply to refrain me from seeking due justice for mine and others in the interest of Corrupts instead of directing to six authorities including CVC to redress of grievances sought by me .
