OPERATOR LICENCE UNDERTAKINGS - Pt 8 This series helps Operators understand the undertakings and promises made to the Traffic Commissioner at the time of having an operator’s licence granted. • Drivers report promptly any defects or symptoms of defects that could prevent the safe operation of vehicles and/or trailers, and that any defects are recorded in writing. There is a legal responsibility on an operator to have a recognised and documented Driver Defect Reporting system in place within their organisations. A driver is required to carry out a daily walk round check before taking the vehicle into use, the walkaround check must be recorded in writing, any defects found must also be reported in writing via the recognised Driver Defect Reporting system in place. When the vehicle is repaired, the person repairing the vehicle must sign off the defect note stating what action has been taken and that the vehicle is safe to return to road use. Further, a driver must monitor the performance and safety of the vehicle and be aware of any defects arising during the working day. Such defects would still need to be submitted in writing and signed off by the repairer via the defect reporting system.
