On Jan. 6, the Centers for Medicare & Medicaid Services issued a proposed rule that would make the disclosure of Medicare physician payment information more transparent and accessible while maintaining the privacy of beneficiaries. The revised policy will take effect 60 days after publication in the Federal Register. CMS said it will evaluate on a case-by-case basis any requests for individual physician payment information or requests for information that, combined with other publicly available information, could be used to determine total Medicare payments to a physician. In making those determinations, CMS said it would consider the importance of protecting physicians’ privacy and ensuring the accuracy of any data released as well as appropriate protections to limit potential misuse of the information. Since 2010, CMS has increasingly released aggregated data, much of it available at healthdata.gov. The AMA has warned the Obama administration that the proposed policy could violate physicians privacy rights if it poorly implements the policy. https://wsma.org/articles/membership-memo/greater-availability-of-medicare-data-propose
