Once again reading beyond the headlines....And this fall into the totally weird category... For whatever reason I decided to look at the actual text of the ACA and found a few things First of all there is nothing called OBAMACARE. Second its 906 pages (at least that is what the PDF is I found) Not 40K as Mitch McConnell seems to think it is. Third its a lot of it is technical boilerplate BS. Fourth and most importantly (and I have copied it below from page 131) While there is an Individual Mandate as the law is written it is from what I can tell unenforceable! No wonder why the President is turning a deaf ear to those who want to delay it. It appears there is actually nothing to delay. I have no idea why it is written like this but it would be nice if before learned people fill the airways with BS they actually get some facts before doing so. Just saying. Is the roll-out a technical disaster YES given the choice between an IT meltdown and a Battery fire on a new Boeing Dreamliner while flying across the Pacific I would choose the IT problem every time! (I dont recommend it unless you need a cure for insomnia and have run out of Ambien) democrats.senate.gov/pdfs/reform/patient-protection-affordable-care-act-as-passed.pdf From page 131 ‘‘(1) IN GENERAL .—The penalty provided by this section shall be paid upon notice and demand by the Secretary, and except as provided in paragraph (2), shall be assessed and collected in the same manner as an assessable penalty under subchapter B of chapter 68. ‘‘(2) SPECIAL RULES .—Notwithstanding any other provision of law— ‘‘(A) WAIVER OF CRIMINAL PENALTIES .—In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure. ‘‘(B) LIMITATIONS ON LIENS AND LEVIES .—The Secretary shall not— ‘‘(i) file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section, or ‘‘(ii) levy on any such property with respect to such failure.’’.
