Open source, in a world where every document ever produced can be digitally filed along with its date, pretty much means that the primary source of an invention or idea could always be identified. Musk makes the argument that, while patents may once have protected inventors, now they just create a minefield that stifles invention and innovation, entrenching vested interests and enriching lawyers. He also recognises that the true competitor to an electric car producer is not others of the same domain, but those producing the internal combustion engine. Technology leadership is not defined by patents, which history has repeatedly shown to be small protection indeed against a determined competitor, but rather by the ability of a company to attract and motivate the world’s most talented engineers. We believe that applying the open source philosophy to our patents will strengthen rather than diminish Tesla’s position in this regard. The same applies to biotechnology and probably every other industry; one side-effect of a smaller world. Patents are also a product of the philosophy of scarcity, which is simply not representative of reality but, now, something imposed by the ruling elites to ensure the rule of fear over the plebicite.
