Attention Acupuncturists! We are asking for your support!!! SB990 has been scheduled for a vote Tuesday November 12, 2013 in the Pennsylvania State Senate Consumer Protection and Professional Licensure Committee. At the bottom of the email we have put all of the members of the committee, their home district office, their Harrisburg phone number, and their websites. If you are their constituent or if you practice near or in their district, please contact by phone their Harrisburg office on Tuesday morning and ask them for their vote. (Monday is Veterans Day.) We have already contacted them on behalf of the APA. Now we want to let them know that there is local interest!!!! SB990: This legislation was introduced as Senate Bill 628 in the 2011-12 Legislative Session. This legislation would amend the Acupuncture Registration Act of 1986, Section 3.1, relating to medical diagnosis and Section 3.2, relating to Liability Insurance. Currently an acupuncturist may treat a person’s condition without the condition being diagnosed by a licensed physician, dentist or podiatrist for 60 days from the date of the first treatment. Beyond 60 days from the date of the first treatment an acupuncturist may treat a person’s condition if the person obtained a diagnosis of the treated condition from a licensed physician, dentist, or podiatrist. This legislation would allow acupuncturists to treat persons who do not present any symptom of a condition without physician diagnosis beyond the current 60 days allowed under law. The reasoning behind amending this language is for the sake of treating a patient for Wellness and preventative reasons. Acupuncture can be used to help in the treatment of Western Pathology, but it definitely can treat a patient who does not have a Medical Diagnosis. In fact it can be argued at times that acupuncture can help prevent a patient from getting a Medical Diagnosis. The language in this bill is an attempt to address this issue in the state of Pennsylvania. In addition, the legislation requires acupuncturists to obtain and maintain a level of professional liability insurance coverage in the amount of $1,000,000 per occurrence or claims made. It also allows the Board to take action for noncompliance. The Board is permitted to accept as satisfactory proof of insurance any of the following: self-insurance, personally purchased liability insurance, or professional liability insurance provided by the licensees employer of similar coverage acceptable to the board.
