Public Notice 7: Please note that in an attempt to avoid filing civil and/or criminal lawsuits that I have personally made multiple attempts to contact the below individuals and I have received no response. These complaints will be reflective of the personal damages that I have incurred. Please consider this public notice that I will proceed accordingly with legal counsel. The lawsuits will be addressed to a contact person when an organization is being sued. Please further note that the complaints are only being directed to certain individuals in which my rights were violated. For example if you are a Baton Rouge City Police Officer and we have had no contact why would I sue you? Or if you are a Sheriff Deputy or Correctional officer and we have had no contact why would I sue you? If you have any questions you are more than welcome to contact me directly until the complaints or lawsuits have been filed with the respective courts and served to the individuals or agency. The East Baton Rouge Parish Clerk of Court Doug Welborn Judge Yvette Alexander Baton Rouge, LA rendered the ruling for this case and my civil complaints are the following: mishandling of Baton Rouge City Case#13-96971, perjury, defamation of character, the inability to maintain control of the courtroom without prejudice, the inability to separate a personal opinion from a fact, violation of my right to my own opinion, and discrimination. In summary defamation of character. All of the details regarding my entire case against the local Subway located at 5225 Highland Rd, Baton Rouge, LA 70808 are listed below. These details are in the process of being delivered to the local owner via a formal lawsuit petition. This is how Baton Rouge City Case#13-96971 started at Subway. (Part I) On November 5, 2013 I arrived in Baton Rouge, LA with the intention of following up in person on the various meeting requests that I sent to Mayor Melvin Kip Holdens office. My purpose for wanting to meet with him was personal/business. I also came to Baton Rouge with the intention of meeting with a potential Business Partner over the Thanksgiving holiday. On November 7, 2013 between 8AM-9AM CST I walked from McDonalds (4215 Nicholson Dr, Baton Rouge, LA 70808) shortly after having breakfast to the local Subway (5225 Highland Rd, Baton Rouge, LA 70808). My intention for going to Subway was to 1) Use Capital Area Transit System to take Route 47 Highland Road (which is in front of the Subway) back to the Capital Area Transit System bus terminal in order to transfer to Route 14 Downtown Shuttle_Thomas Delpit 2) Purchase a footlong Spicy Italian Sandwich, and 3) Use the restroom and change my clothes. Upon entering the Subway restaurant located at 5225 Highland Rd, Baton Rouge, LA 70808 I noticed about 1 or 2 customers in the restaurant who appeared to be waiting to be served. The staff appeared to consist of a Sandwich Artist® (or Senior Sandwich Artist®) and a Shift Manager. As I was proceeding to the restroom one of the staff indicated to me that there possibly was someone in the restroom. I responded that it was no problem and that I would wait. I waited about 2-3 minutes and a young woman came out of the restroom. I noticed that this was one of the employees from the McDonalds where I had breakfast (4215 Nicholson Dr, Baton Rouge, LA 70808). I went into the restroom and proceeded to take care of my personal needs. About 15 or 20 minutes later there was an aggressive knock on the door and I responded someone is in the restroom how can I help you? and no one answered or indicated that they needed to use the restroom. About 5 minutes later there was an even more aggressive knock at the door and I responded how may I help you. The person responded very loud, unprofessional, angry, and disruptive that I better come out of that bathroom. Due to the intensity of the persons tone I immediately stop combing my hair and existed the restroom to better understand what was happening in the restaurant. I wasnt sure if the restaurant was being robbed or if someone was perhaps being threatened. I wasnt sure what I was getting ready to walk into. Upon existing the restroom I saw about 2 or 3 other customers, however it did not appear that anyone needed to use the restroom. Therefore I waited patiently and proceeded to the counter to inquire as to who/why someone was aggressively knocking on the door. I actually thought that it was a kid doing a prank and couldnt believe that it was actually one of their employees who did this. I looked at both employees (both were African American women) and I asked was someone knocking on the door? The taller lady responded that yes I knocked on the door with a very aggressive attitude. And before I could respond she proceeded to say that I had been in the bathroom too long and she had other customers waiting to use the restroom. I looked around at the 2 or 3 customers that appeared to be waiting for service and no one confirmed that they needed to use the restroom. Therefore I responded to her okay thats no problem and as I was returning to the bathroom to grab my belongings she verbally attacked me. This employee made accusations that I had no intention on purchasing anything, she noticed I was homeless because she watched me walk up to the restaurant with my two little backpacks, and the final insult came when she told me (a customer) that she would call the police. I was really taken aback with all of her comments. I stated to her that she should not make any assumptions about my ability to pay she then proceeded to insult me about my wig along with other insults. She repeated again that she would call the police if I did not come out of the restroom immediately. I told her she just walked into a lawsuit in an attempt to make her think about what she was saying to me as a customer. At this point I was thinking its best that the police should be called because I wanted to file a report in order to follow-up with the owner regarding the incident. Therefore I proceeded back to the restroom where I would wait for the police to arrive. Here is something to think about 1) This local subway is located at 5225 Highland Rd, Baton Rouge, LA 70808 in the heart of LSU. Could I have possibly been an LSU student with two backpacks coming to grab a sandwich and use the restroom? Why did the employee make the assumption I was homeless with no money? Furthermore why did she call the police when I was not being disruptive in the restaurant? 2) Assuming this person was a Shift Manager (The Shift Manager supervises the operations of a shift to ensure that food safety, product preparation, cleanliness and inventory control standards are maintained. This may include scheduling and supervising staff. Exceptional customer service is a major component of this position), where was the customer service? Stay tuned for Part 2 when I reveal the events that took place when the Baton Rouge City Police arrived. (Part II) After I returned to the restroom where I would wait for the police to arrive. All of a sudden there was a huge knock on the door that startled me. I assumed that this could not be a law enforcement officer and to my amazement after opening the door it was Baton Rouge City Police Officer (Caucasian male) from the Baton Rouge City Police department. Upon opening the door he yelled with even more anger intensity than I have ever witnessed with any law enforcement officer to come out of the bathroom. It was at that moment I lost all respect for any law enforcement officer who did not respect the oath (to protect & serve). I was not combative or disruptive with the employees nor was I with the police officer, until he asked me to leave the establishment without asking me one question as to what happened or why was I there-I was a customer. And in this instance whereas the police officer may have observed me from his perspective as being combative or disruptive I was cooperating as best as I could (given the circumstances) by being submissive and quiet. He along with the subway employee who called the police both were hollering at me at the same time. I told the police officer that this would not be happening on the other side of town (the most wealthy area) and he said nothing. I was looking for him to respect the oath regardless of where you live at. The policeman never had control of the situation because the employee would not allow me to speak. Instead of him asking her to allow me to speak in order for him to determine the events (probable cause to the arrest) that led up to him being called to the restaurant, he joined in on the employees dialogue which was disrespectful to myself as a business woman, a customer, and a native of this city. One of the most memorable disrespectful/mistreatment moments as a citizen/customer took place when the police officer told me over the course of his dialogue (the police officer/the subway employee were excluding me from the conversation) that if I did not leave the premises he would arrest me. Again he never asked me not one question as to my version of the events. I responded to him that I am not leaving because I am a customer. The dialogue further continued with the subway employee (an African American woman) making the statement she noticed I was homeless because she watched me walk up to the restaurant with my two little backpacks. I reaffirmed to her she was making a mistake by requesting to have me arrested . I told her my name, I indicated I was a business owner, SU Alumnus, and that I am a native of Baton Rouge and she ignored me. The second most memorable disrespectful/mistreatment moment as a citizen/customer took place when I asked the subway employee while standing in front of the counter if she would take my food order because I am a customer, and I clearly displayed my ability to pay ($20) and she refused to serve me. The Baton Rouge City Police offer witnessed this and said nothing. The police officer acted as though he was trying to bargain with me by instructing me with a lot of anger to just leave, go, etc. At that point I stood up for what I believed in and I told him then take me to jail. He then proceeded to take me into custody by walking in front of me (I was not cuffed at this point) heading out of the restaurant. Upon exciting the restaurant he grabbed my arms (with much force/anger) and put them together behind me as if I was resisting arrest (which I was not), suddenly two Baton Rouge City Police Officers appeared from my left (as I was heading out of the restaurant) and one added additional force while the other officer watched. They both placed me into handcuffs as if I was resisting arrest, which I was not, and the other officer watched as the arresting officer took me to his vehicle. Once the two additional officers left the scene he proceeded to place me in the back of his vehicle. Having never been arrested before I was scared as to what was next. Obviously I did not plan nor did I seek out to be arrested otherwise I would have worn a much longer skirt (my skirt was mid-knee length). As I proceeded to get in the back of his vehicle I struggled to pull my skirt down (because my hands were cuffed). And I observed him watching me struggle to get settled in the back of his vehicle without the officer turning his back to allow me to help myself a little better with my skirt or without him offering to help pull my skirt down. (Part III Arrest Case Summary) Here are a few issues to think about This local subway is located at 5225 Highland Rd, Baton Rouge, LA 70808 in the heart of LSU. Could I have possibly been an LSU student with two backpacks coming to grab a sandwich and use the restroom? This is a clear example of social/economic discrimination. It is social/economic discrimination because it is an example of an assumption based upon a particular group of individuals. Why did the subway employee make the assumption I was homeless with no money? There were no visible facts of this nor any communication from myself regarding my socio-economic status. Again social and economic discrimination. Furthermore why did the subway employee call the police when I was not being disruptive in the restaurant, no customers were complaining about me, or waiting to use the restroom? Again social and economic discrimination. Assuming the subway employee was a Shift Manager (The Shift Manager supervises the operations of a shift to ensure that food safety, product preparation, cleanliness and inventory control standards are maintained. This may include scheduling and supervising staff. Exceptional customer service is a major component of this position), where was the Exceptional customer service? How could a Baton Rouge City Police Officer determine probable cause to the arrest without asking me not one question or allowing me the opportunity to speak. Even in a court room the Plaintiff and the Defendant have the opportunity to express their version of the events? Again social and economic discrimination. How could a Baton Rouge City Police Officer have so much anger upon arriving on the scene that he could not exhibit Communion 101 which is to listen? Again social and economic discrimination with the addition of anger. How could a Baton Rouge City Police Officer witness reverse discrimination by the subway employee who was an African American woman who was refusing to serve me even after I clearly displayed my ability to pay? Again social and economic discrimination. How could a Baton Rouge City Police Officer engage the assistance of two additional male police officers (excessive force) when I was not resisting arrest? Again social and economic discrimination. In summary these are the events relative to my arrest under Baton Rouge City Case#13-96971 which is now a civil matter. I will escalate these detailed events to the Mayor Melvin Kip Holdens office as well as Governor Bobby Jindals office in an attempt to avoid filing an official lawsuit. A civil notice will be issued separately to Subway located at 5225 Highland Rd, Baton Rouge, LA 70808. Feel free to share this public announcement. The city court case that will be connected with this Civil Suit (petition for damages) is case#13-96971.
