Gule Member BARANGAY RESOLUTION NO.: ___ , SERIES OF 2014 “A RESOLUTION INTERPOSING NO OBJECTION OR OPPOSITION FOR THE EXISTENCE, CREATION AND CONSTRUCTION OF A 2.3 HECTARES WASTE TO ENERGY FACILITY BUILDING/PROJECT (A JOINT PROJECT BETWEEN GLOBAL GREEN INTERNATIONAL [AUSTRALIAN BASED COMPANY]AND THE CITY GOVERNMENT OF TAGUM THROUGH MOA)TO BE SITUATED AT PUROK MANGGA, BARANGAY SAN AGUSTIN, TAGUM CITY” WHEREAS, LG CODE of 1991, Section. 384. Role of the Barangay. - As the basic political unit, the Barangay serves as the primary planning and implementing unit of government policies, plans, programs, projects, and activities in the community, and as a forum wherein the collective views of the people may be expressed, crystallized and considered, and where disputes may be amicably settled WHEREAS, LG CODE of 1991, Chapter 4, Section 391. Power, Duties and Functions of Sangguning Barangay (1) Enact ordinances or Resolutions as may be necessary to discharge the responsibilities conferred upon it by a law or ordinance and to promote the general welfare of the inhabitants therein; WHEREAS, the construction of ” WASTE TO ENERGY FACILITY BUILDING/PROJECT” is previously propose to be constructed at dumpsite under Lopez property is moved to Jacinto Diego property situated at Prk. Mangga, Barangay San Agustin, Tagum City WHEREAS, the construction of ” WASTE TO ENERGY FACILITY BUILDING/PROJECT” situated at Prk. Mangga, Barangay San Agustin, Tagum City is part of the joint project between GLOBAL GREEN INTERNATIONAL (AUSTRALIAN BASED COMPANY)and the City Government of Tagum through MOA; WHEREAS, upon the construction of the ”WASTE TO ENERGY FACILITY BUILDING/PROJECT” the City Government of Tagum, shall evaluate, guarantee and ensure the necessary requirements such certifications, permits and other form of health and environmental compliance that may be deem hazardous in the future among all inhabitants of Barangay San Agustin, Tagum City, WHEREAS, the construction of” WASTE TO ENERGY FACILITY BUILDING/PROJECT” to be situated at Prk. Mangga, is a potential income/labor generating and more beneficial among all the inhabitants of Barangay San Agustin, Tagum City thus the native inhabitants that suits for the qualifications as to job description shall be given more priority. WHEREAS, the MOA that binds between the City Government of Tagum and Local Government of Barangay San Agustin shall be favorably follow for the benefits and welfare of the local resident of Baranagay San Agustin. WHEREAS, the delay for the construction of ” WASTE TO ENERGY FACILITY BUILDING/PROJECT” situated at Prk. Mangga, Barangay San Agustin, Tagum City will obstruct and negatively affect the implementation of the project that will lead detriment of the public; NOW, THEREFORE, on motion by Kagawad Andy A. Gallo, duly seconded unanimously; RESOLVED, as it is hereby RESOLVED to approve the construction of ” WASTE TO ENERGY FACILITY BUILDING/PROJECT” situated at Prk. Mangga, Barangay San Agustin, Tagum City RESOLVED further, that the CENRO office be accountable to the local government unit council and render regular reports on the project implementation; RESOLVED, FINALLY, to furnish copies of the Resolution to the Head of the Department of Environment and Natural Resources Provincial Officer, CENRO City Officer and all concerned for their information and appropriate action.
