SRC Statement on Muzi Gwebu outcome The Student Representative Council notes and respects the decision taken by Regional Magistrate Judge Rasheed Mathews and the findings of the South African Human Rights Commission in the Muzi Gwebu case. The Courts and the Commission have an inherent, external and independent duty to investigate and protect the dignity and rights of citizens and society in pursuit of social justice, constitutional democracy and equality. This is a role that is to be executed without fear or favour and a process that should not coincide with an institutions duty to protect the rights and safety of students. The Student Council also notes the University’s decision to uplift suspension and not to continue with disciplinary action with disappointment and concern*. On the 17th of February 2014, a violent incident took place on campus, a student ended up in hospital and a matter subsequently ended up in court. The council submits that the acquittal of these charges does not relief the University of its duty to- at the very least- continue with internal investigations and proceed with disciplinary action. We note the fact that the parties and University would like to lay the matter to rest but the Student Representative Council is concerned about the precedence that the incident and the University’s reaction to this matter has set as there has been serious breach of UFS rules on student discipline and misconduct. It is important that a firm stance is taken against violent behaviour- especially of this nature and that students are aware and fear the repercussions of such behaviour. This in light of the findings, would apply to both parties. The Student Representative Council would like to state that we are against violent behaviour, racism and discrimination of any form. We would like to urge fellow Kovsies to continue striving for a community based on mutual respect, equality and acceptance. Not only would we like to extend the apology to the student community at large but also to Mr Gwebu. *At the time of release, the SRC was still awaiting a response from the University and is currently engaging the University Disciplinary Committee on the matter.
