So, Ive been reading up on some legalese about copyrights, patents, and the like regarding video games. As it was explained to me, so long as you dont actually utilize assets(Art, direct code, etc) you can makes a functionally direct copy of a game. IE all of the flappy bird clones there are out there now. This brought an idea into my mind; some games (COD, BF4, Skyrim) are wildly successful, and by nature of how open games like Skyrim are, it would be incredibly easy to make a functional copy of the game. So, the question, if another free roam, sandbox RPG that had literally identical mechanics and gameplay to Skyrim, but, say, was set in another nonrelated fantasy world, popped up, would it be possible to pursue legal action?
