Some people absolutely astonish me… I sent a message to a customer asking them to remove the a image from their facebook page… that I had not given permission for them to use… This is the response that I got: EMMA LOUISE JOHNSON Ill remove it ASAP I think in future you should inform clients that they arent allowed to use the demo pics on their facebook. I was not aware that it would offend you so much. so much so you felt you had to write a ranting status about me on FB. Sorry 4 any inconvenience caused. AN OPEN LETTER: Dear, Emma Louise Johnson, Im sorry your unaware of copyright laws, perhaps I can explain it to you... The Copyright Act protects photographers by giving the author (creator) of the photograph the exclusive right to copy, edit, and distribute image by sale or transfer. These exclusive rights make it illegal to copy, scan, or edit, or share photographic prints and digital media without the photographer’s permission. Violators of this Law will be subject to its civil and criminal penalties.” I do encourage all my wonderful customers, to share images that I post on facebook, I give them permission next to the image. I watermark these images with my logo, after all it helps promote my business and allows them a little sneak peek from their session. When you post an image on your facebook page, that was sent to you as a proof copy, to see if you were happy with the storyboard that you requested that I create… (not posted to my business page) so you could finalise an order! Its not ok… especially when you never placed the order but used the image on your facebook page for the enjoyment of your family, friends and yourself. This image was never a demo on my business page, it was sent in a private message, requested by yourself as apparently you were unable to access your online slideshow... As I explained to you in my email, LISA GALLAGHER As you can understand, when sending customers copies of their images to view, I have to place a lot of trust in them and hope they understand all the time and care that I put into my work. I am after all trying to earn a living… it is stealing from me when customers use their images without my consent I am sorry if I have offended you in anyway by my earlier email and that you didnt realise the point of booking a photo session for your daughter, meant that you purchased goods, once I had finished the job that you employed me to do. Obviously if you had of been unhappy in anyway with the session or the images that I created for you, of course I would never have expected you to make a purchase and would have been more than happy to offer either a full refund or offer you a another photo shoot. Given this was not the case with you, as you sent me the following message after your slideshow was uploaded to your online gallery. EMMA LOUISE JOHNSON hi lisa pics are beautiful few changes to my story board: jp4 top left, jp8 centre, jp7 bottom left and also can you put her name in the box as Gracie-Lou. is that ok ? and can i see the board once changes are made? thank you xxx Id also like to point out that I never named anybody in my earlier ranting status on facebook which was posted on the 14th October, I sent you a message asking you to remove the offending image, on the 8th November… so Im unsure as to why you think this post was directed at you! Perhaps a guilty conscience? I trust now that you have removed the image from your facebook page (and I can always dream from every electronic gadget that you own) we can put this to bed.
