State loses theft case against Besigye aides Done with. The case involved three aides who were charged with robbing a hawker of Shs110,000 and two mobile phones during campaigns for Kasese District woman MP by-elections. Kasese. Three aides of former Forum for Democratic Change (FDC) party president Kizza Besigye were on Friday acquitted of robbery charges by a magistrate’s court in Kasese District. Mr Francis Mwijukye, Mr Sam Mugumya and Mr Robert Kisekwa have been on trial for charges of simple robbery. Prosecution alleged that on August 4, 2012 while campaigning for FDC’s Winfred Kiiza in the Kasese District Woman Parliamentary by-elections at Maliba Trading Centre, the accused stole two mobile phones and Shs110,000 from a hawker. During the trial, the alleged hawker, Mr Ismail Muyingo from Makerere Kikoni zone in Kampala, was discovered to be a policeman after the defence lawyer, Mr Geoffrey Sibendire, produced his photographs showing him on duty in police uniform. In his judgment on Friday, the magistrate said the prosecution witnesses failed to place the accused persons at the scene of the alleged crime. “Prosecution witnesses contradicted themselves in identifying the accused at the scene of crime. This raised a doubt as to whether the accused were at the actual scene of crime,” said the magistrate. The magistrate observed that the complainant himself failed to identify the accused persons and confessed he did not know who exactly stole his phones and the wallet which contained the money. While making their defence, Mr Mwijukye, Mr Mugumya and Mr Kisekwa told court that on the said day, they had been sent to Kilembe and Kisinga sub-counties and Mpondwe-Lubiriha Town Council respectively to train polling agents.After the judgment, Mr Sibendire said the robbery charge had been concocted by the State against his clients. Mr Mwijukye said he was happy with the judgment but threatened to sue the Inspector General of Police (IGP), Gen Kale Kayihura.
