Statistically speaking the insanity defense (which is an affirmative defense to criminal prosecution which does not deny the charge but instead questions the intent element by essentially claiming that due to mental illness or brain damage the Defendant could not distinguish between right and wrong) almost never works. Juries do not buy insanity with any regularity and only the smallest minority of insanity defenses are successful.
