Summary Of My Conclusions – JJ Report – Crazy Ships Crashes Link for Seeing, Signing & Sharing Petition - maritimenz/AnnulConvictionGainedByAbuseOfCourtProcess 1 – On the day of the incident, Classique was heading in an Easterly direction from her Auckland Harbour mooring, to an anchorage on the Sth Western side of Motuihe Island. Seaway was heading in a Westerly direction from her Kennedy Point wharf on Waiheke Island, around the Sth end of Motuihe, to around the Nth side of Browns Island prior to then heading for Auckland. 2 – The incident occurred as outlined in the reports & an ‘uncomfortable’ closest point of approach distance was experienced by the vessels about 0.25 nmiles NE of Browns Island Beacon. 3 – The purpose of my investigation was to examine the circumstances as shown by the evidence, apply consideration of the appropriate ‘collision rules’ & reach conclusions regarding actions taken or not taken by the 2 vessels. 4 – On the day Classique was travelling about 7 kts & Seaway at about 15.5 kts. My reading of the evidence is that the 2 vessels were observing each other & keeping proper look-out. 5 – No plotting of positions on charts, paper or electronic, was being carried out by either vessel. Both vessels were navigating by eye using their familiarity & experience in the area. 6 – The weather on the day was fine, with good visibility & a gentle easterly breeze. It was near high tide, plenty of clear water & few other vessels were in the area to influence any decisions to be made. The only land nearby was Browns Island beacon. 7 – The argument of Seaway was that Classique was a crossing vessel, with risk of collision & therefore Classique should give way to Seaway. 8 - The argument of Classique was that Classique was a crossing vessel that would pass safely ahead of Seaway on the courses they both were on with no risk of collision, so no course alteration by Classique was required. However Seaway did not maintain course & speed, which if Seaway was concerned about possible risk of collision (Rule 22.7.1) was the requirement under Rule 22.17. Seaway thereby contravened Rule 22.17 & caused the close quarters situation to develop. Continuing ...
