The European Court of Human Rights, after having requested clarifications under the urgent procedure, decided NOT to indicate to the Greek Government the interim measure the Syrian refugees protesting on Syntagma Square had requested on November 24th, concerning the urgent protection of their rights to life and dignity, and invited them to provide all documentation concerning their application until 20 January 2015, under the regular procedure. The answers of the Greek Government that The Court received were not communicated to the representative. However, the Government had publicly declared that it cannot host nor feed all Syrian refugees, even if they asked for asylum, nor made any move to provide urgent protection or call for EUs help to cope with the admitted inability to respect fundamental rights. Given that some of the applicants are unaccompannied or accompanied minors, kids that, after short detention, were left unsupervised on greek streets with suspended deportation orders, given that many have been physically and mentally exhausted from reasons related to their asylum-seeker identity and their -medically unassisted- hunger strike since Nov24th, and given the fact that many decided to seek illegal routes to reach other EU countries, as a desperate solution most of the protestors will choose, and died while doing so, I believe that the decision not to indicate an interim measure on such a striking case of massive danger of life and shattering of human dignity, and the inability of the Court to safeguard the lives of those in jurisdiction of states that have ratified the Convention, reveals a serious gap between what the Convention guarantees in theory and what it ensures in practice, in a way that cannot be deemed acceptable in a democratic context..
