The Saudi Ministry of Labor has warned all recruitment offices for authorizing others either compensating in cash or without, which is entitled as violation of the labor regulations. Al-mofarrej continued saying that the ministry has requested MOFA to provide a report on the number of authorizations issued for recruitment offices. The ministry has suspended 20-violated offices based on Article 56 of the Recruitment Offices Regulations that states closure of such violated offices that misuse the online authorization. The MC Director pointed out that most problems stemming from authorizing recruitment offices are influx of the foreign labor into the Kingdom without the employers knowledge which results in dismissing rights of both employers and workers. This has led to unlicensed recruitment offices and agents breaking into the market in which rights are hard to restore and maintain if a citizen lodges a complaint against the recruitment process. The new enforcement aims at regulating the contractual relationships between employers and domestic workers in which a set of obligations and responsibilities are incumbent upon the two parties. Ziad AlSayegh, the Undersecretary for Customer Service and Worker Relations at Ministry of Labor, urged both parties to comply with articles and clauses that are duly stated in the regulation. The 23d-artcile regulation takes into account the delicate nature of tasks exposed to a domestic worker while dealing with the employer and his family in a private setting without infringing on he commented. He added that the mandatory standard contract provides penal actions if terms and conditions are breached by any of both parties or together, protecting their rights at all levels. AlSayegh reiterated that the regulation allows employers to put domestic workers on a three-month probationary period so that their qualifications and personality are double-checked and tested. Moreover, domestic workers must abide by the Islamic rules and respect the cultural subtleties in light of observing the Saudi laws and executing agreed chores as per the de facto contract without omission. The regulation declares articles that a domestic worker should follow without a failure to act, to mention but a few: s/he is entitled to obey the orders of the employer and his family members to carry out duties as agreed upon. Also, he must maintain properties owned by the employer and that of his family. Furthermore, he should not cause any harm to the employer including children and elders. In addition to behavior and work ethics, he must guard the secrets of the employer, those of family members and other dwellers due to the fact that domestic workers can come into contact with personal matters at work besides not disclosing them. Moreover, he must honor the dignity of the employer and his family. The regulation highly emphasizes that domestic workers or laborers are not legally authorized to refuse or abandon work without legitimate reasons. It provides in text and spirit a complete prohibition on domestic workers to work on their own capacity without their official sponsor or practice any activity that puts his family in grave danger. The Undersecretary ensures that the regulation does not provide a right for employers to delegate any task that is not solely stated in the mandatory contract; nor a right to endanger laborers safety or disgraces them. Employers are required by law to not let their domestic laborers work for other sponsors. He emphasized these provisions guarantee the due wage paid to laborers in terms of fixed time and amount as well as documenting payments in writing. Employers should provide a proper housing for laborers with a daily recess period of not less than nine hours and a weekly one day off that allows them to rest as per agreement.
