The cross border movements both on land and marine time and activities have not been very conducive to India and Pakistan with regard to bilateral relationship and these happening which have so far not been checked successfully by either sides. Offenders have been successful in committing an offence on one side and have crossed over to the border to the other side and vice versa. This activity that has been going on needs to be addressed to and a solution is required. There have been endless accusations and counter accusations from both sides which have only promoted political distrust and antipathy. This need to be changed hence both mutual perceptions and the entire gamut of relationship needs a serious review. Trust, amity and fraternity are the need and this need to be developed. A degree of transparency and better harmony is needed to further this bilateral relationship.The solution lies in signing of an Extradition Treaty between the two neighbours. There have been frequent instances of offenders having escaped from one side to the other after having committed an offence that has been most heinous or conspiracies to undermine or subvert the neighbour and to promote a seditious activity in the neighbourhood have been frequently hatched and executed. The master mind or minds behind the conspiracy or conspiracies have been sitting across the border on a comfortable saddle and have neatly executed their plots. This entire game has been going on since the last three to four decades and this is a known fact. As the offenders and their master minds are not having any criminal record within their nation of domicile they enjoy a status of a respected citizen that particular nation. Such elements who are latent anti-social and anti-national elements need to be brought to the books and Extradition Treaty alone can to an extent help in booking such offenders. The parameters of an Extradition Treaty will need to be worked out considering the geo-political factors governing India and Pakistan which makes the task all the more challenging. In addition the cut off date too will be needed and certain cases may have to be overlooked or written off. Besides, as a part of the Extradition Treaty the governments of the two countries can and should take the resolve to check any sort of activity that is against the national interests of their neighbour and off course their own. This alone shall help in ushering in more cordial and amicable relations between the two neighbours and shall be able to develop the required trust and amity which is essential to develop the congenial environment. There are as we shall agree groups and lobbies on either side that will not be supportive of this idea and hence will have their arguments to ensure that such a treaty does not come through. Perhaps vested political interests that grow on antipathy and distrust are the governing factors of any such moves but the time has come to set right such elements on either sides. Extradition Treaty is indeed a very difficult task to implement and will require a sincere joint effort from either sides which alone can make this a reality which at present does seem a pipe dream. The legal parameters off course need to be worked out in accordance with the constitution of this country wherein those clauses are not in compliance with the constitution can be declared ultra vires but a workable extradition treaty can and should be worked out. Arrests caused on account of transgression of territorial waters by fisherman is quite common and as the availability of fish at the mouth of Indus is much more when compared to the Kutch region due to various factors geographical and man made the problems need to be given due attention and a comprehensive solution should be found. A working arrangement with a kind of a pass if not visa can be given to fisherman from India and Pakistan who fish into the high seas thus in case of entering into territorial waters they shall only be made to pay a sort of entry tax which can be defined as a marine tax. Fisherman can be given a specific kind of card or document approved by the governments of India and Pakistan not necessarily a visa or passport
