The great Phuket cleanup, as it is called in the press, seems to be just the start for a big bang policy change in Thailand. While the military junta government started with a reclaim of public land from bars, resorts and hotels which illegally used some parcels for which they have no land title, now they declare the issuance of Chanotes and land transfers as void, if they have been accomplished by a criminal act. Under Section 157 Criminal Code any official, who wrongfully exercises or does not exercise any of his functions to the injury of any person, or dishonestly exercises or omits to exercise any of his functions, shall be punished with imprisonment of up to ten years. The next developments will show whether this all is limited to Phuket and limited to real estate. There are some reasons to believe that the new policy will finally cover other areas of Thailand, including Bangkok, and other areas of the law, including naive corporate structures, which violates the Foreign Business Act as well as the land Code of Thailand.
