The facts are as follows: In the early 1980s Greensleeves issued six dub albums (collectively the “Masters”): 1. Scientist v. Prince Jammy – Big Showdown 2. Scientist – Heavyweight Dub Champion 3. Scientist Meets the Space Invaders 4. Scientist Rids the World of the Evil Curse of the Vampires 5. Scientist Wins the World Cup 6. Scientist Encounters Pac-Man The issue of Greensleeves ownership rights in the above Masters was finally adjudicated in Paris, France commencing in approximately 2008. On December 14, 2011 the Court of Appeal of Paris issued a Judgment finding Greensleeves liable for infringement of The Scientist’s rights in each of those recordings. The Court of Appeal awarded damages in favor of The Scientist and against Greensleeves in the amount of xxxx euros for the unlawful importing and marketing of those six albums, and prohibited Greensleeves and PIAS from further distribution of those albums in France under penalty of fine of xxxx euros per infringement. Note that the above releases were unauthorized, The Scientist never entered into any arrangement with Greensleeves or anyone else authorizing the release of the Masters. Nor The Scientist ever entered into any administration or publishing agreement with respect to his underlying compositions embodied on those albums (the “Compositions”). Nor was Greensleeves ever granted any right to use The Scientist professional name and likeness in connection with the sale of the above albums.
