This month, Steven Weinberg presents an analysis of Berkley Regional Insurance Company v. Weir Bros., Inc., et al., Case No. 13-cv-03227 (S.D.N.Y. He describes how the intended and desired enforcement of the jurisdiction, venue, choice of law, prima facie proof and the Surety’s right to settlement provisions in an indemnity agreement was achieved when defendant indemnitors filed a motion to dismiss for improper venue, a motion to transfer venue and opposed Plaintiff Surety’s motion for summary judgment.
