We completed a successful Status Trace today and a route to British Nationality for an applicant born in Brazil. Her mother was born in the former Kenya Colony and her father in the USA. The Borders, Immigration and Asylum Act 2009 allows for the children of British mothers to acquire British Nationality now where the subject would have become British but for the gender discrimination in the 1940’s legislation. The subject would have acquired Citizenship of the UK & Colonies in the pre-1983 period but for gender discrimination at the time. After assessing that she would not have been subject to the automatic loss of her British Nationality with the Independence arrangements for Kenya, it was determined that she could acquire British Nationality in the modern day.
