2014 Jul 25 - The City of Port Jervis and the Port Jervis Police Department are pleased to announce that on Monday, July 21, 2014, its officers were cleared of alleged civil rights violations after a federal jury trial was held in the United States District Court for the Southern District of New York. In 2010, the plaintiff filed a civil complaint in federal court alleging that the City’s police officers had assaulted, battered and used excessive force against him, and then maliciously prosecuted him on a false charge. Following six days of testimony, the jury of four men and four women took only two hours to return a verdict finding in favor of the City of Port Jervis and the police officers involved on all claims. The City of Port Jervis and the Port Jervis Police Department are committed to providing the highest level of protection and service to its residents. The City and the Department were determined from the outset of the action to vigorously fight the false allegations lodged against its officers, and vow to do so in the future, if necessary. The City and the Department are pleased that its officers were vindicated, and commend the legal counsel provided them by Hobart Simpson and Joseph McKay during the three-plus years of litigation. Simpson & McKay are partners at the Newburgh/Fishkill law firm of Catania, Mahon, Milligram & Rider, PLLC.
