27 June 2013 Joint Press Statement by Women Section of KLSCAH and Malaysians for Beng Hock Prosecutor’s Charge Amiss, Judicature Connives Women Section of KL & Selangor Chinese Assembly Hall and Malaysians for Beng Hock are deeply shocked upon hearing Brutal Rape and Murder Case of Chee Gaip Yap. High Court Judicial Commissioner Datuk Mohd Zaki Abdul Wahab pointed out that there is insufficient evidence to implicate that Shahril injured, or even murder Chee Gaip Yap. Therefore, the defendant was acquitted from Penal Code Section 302 (Murder), due to lack of evidence. We believe that there is mishandling in this case. First, Public Prosecutor charged the defendant over murder, but not rape and murder. Evidence showed that Shahril’s semen was found in the victim’s private part, is this still not enough to prove that defendant has committed rape? Commissioner’s dereliction of duty has resulted in a “non-guilty” verdict. If prosecution of rape crime is only made out of social pressure, how might the Public Prosecutor explain to the public, when the suspect escapes once again? This is not the first time Shahril being a fugitive suspect. As the defendant Shahrir fled to Australia immediately after released on police bail after the incident in 2006, it is obvious that he escaped himself from Deoxyribonucleic Acid (DNA) sampling. He was only apprehended by police upon his return in 2012, long after the pending investigation. These signs are somewhat suspicious. Secondly, High Court Judicial Commissioner should have been aware of the shortcomings with his vast experience, yet he was silent of Public Prosecutor’s dereliction of duty, hence allowing the defendant to refute the testimonial over “technical errors”, and resulting court case ended without further trial. This makes people wonder, Is judiciary system actually made to watch over truth out of voice of justice, or to contain loopholes for criminals to slit through? We therefore strongly question the professionalism of the judgment and request Public Prosecutors not to undermine the evidence that defendant’s semen was found in victim’s private part. Police should treat the defendant as rape suspect (or as murder and rape victim), by carrying out in-depth investigation once again, in order to maintain legal justice and seek the truth for her death.
