A Different Solution to Illegal Immigration I think that a different approach is possible on the illegal immigration issue that would constitute a win-win solution for those who represent the 67 percent of the bell curve shaped political distribution. I agree with such positions as securing the borders and the expedited deportation of any illegal immigrants with criminal records. I think even Obama Democrats will give lip service to those positions. Whether they will work to do anything about it is another question entirely. What most concerns me, however, is the real sticking point in illegal immigration. That is the millions of people who have been living here illegally. They are here because a bipartisan problem is that nobody ever bothered to enforce the laws on the books. There are so many laws on the books that we have reached a point in the federal system that the employees of the federal government have to exercise some selectivity in what is enforced and what is not enforced. That, I would state, is just my opinion, but I consider it a fact that there are active cases and active actions in the millions that have not been pursued because nobody cared and nobody was told to do it, and nobody believed the case could be worked to a successful conclusion anyway. That phenomenon in the overly litigious federal system does not apply just to the subject of illegal immigration. It applies to OSHA. It applies to Medicare fraud (If you cant make a case, do you close it out and send a goodbye letter to the subject or do you leave it open and forget about it?). More than likely, this condition applies to the NRLB for any claim of unfair labor practice cases brought against employers while Obama has been in office. And it most assuredly applies to mountains of claims made under EEO that neither side has ever heard from or heard about. What happens too often is that people in Congress become exorcised by something and they pass a law. It is just like the old saying about locking the barn after the horse has been stolen. They only had one horse. So no one else can steal another. But we go ahead and pass a law anyway because it looks good. And then we forget about it. Thats not the way to run a country. I am sure all would agree with that statement. The questions remains of what we do to fix it. My proposal is a trade, a one for one swap. We pass a law that requires federal agencies to observe a strict statute of limitations. It would need to be three years and possibly five years but no longer. No action taken on a case in five years and the case is marked closed, marked Lack of action. The subject is notified by certified mail that the allegations not have sufficient merit for further action and no federal enforcement will be pursued. The Notification will constitute a Release of Adverse Actions that might otherwise apply to the holder of the release if the actions were actively being pursued or the allegations were found to be true. This instrument of Release would not stop a long term illegal immigrant from getting a drivers license. It would not bar an employer from bidding on a federal contract who had been accused in a case thatr went into a black hole of violation of civil rights or of OSHA violations that no inspector ever bothered to check. To reiterate, we do this on a one for one trade. One illegal immigrant gets a pass. One party on the conservative side that some liberal activist wanted to bludgeon with the stick of the federal government also gets a pass. I am convinced that in this straightforward trade you will find as many actions against conservatives that can be dismissed, especially if you bring in the Obamacare unfunded mandate, as there are illegal immigrants in the United States. That is my compromise solution on illegal immigration or the core of a compromise solution on illegal immigration. In the end, however, the real key to redundant and useless laws is accountable law making. I am trying to start a party I call the Equity Party. All candidates will solicit and document the solicitation of the constituent on five votes during a session in Congress. All candidates will also agree to support term limits on all bills other than annual appropriation bills. That will give us a level of accountability that will enable us to at least minimize this kind of mess in the future.
