A clients mother died without a will or any writing regarding disposition of her body after her death. Her son wanted the body sent to another state, and the daughter wanted the body buried in the state where she and her mother lived. The funeral home decided to follow the sons wishes since he was the oldest child. The funeral homes actions were in violation of Ohio law. Where two or more children are left to decide upon the disposition of a parents body, and they disagree, the matter must be submitted to the Probate Court, where a judge will decide.
