ANG BABAE O MGA ANAK NIYA NA SINASAKTAN NG KANYANG ASAWA O KALIVE-IN O BOYFRIEND O MAY BANTA NG PANANAKIT AY PWEDENG KUMUHA NG BARANGAY PROTECTION ORDER NA NAG-UUTOS NG PAGPAPA-ALIS NG LALAKI SA BAHAY O PAGBIBIGAY NG CUSTODY NG BATA SA NANAY O PAGBABAWAL NA MAKIPAGCOMMUNICATE ANG LALAKI SA BABAE AT ANAK, UNDER REPUBLIC ACT NO. 9262 OTHERWISE KNOWN AS ANTI-VIOLENCE AGAINST WOMEN AND THEIR CHILDREN ACT. ANG BARANGAY PROTECTION ORDER AY LIMITADO LAMANG FOR FIFTEEN (15) DAYS. ANG BARANGAY PROTECTION ORDER AY ISANG MAHIGPIT NA UTOS NA DAPAT SUNDIN NG LALAKI AT ANG PAGLABAG DITO AY MAY KARAMPATANG PARUSANG KULONG. Marami ang biktima ng domestic violence o pananakit ng mga asawa o kinakasamang lalaki sa mga babae o sa kanilang mga anak at karamihan ay hindi nila alam kung ano ang mabilis na paraan para sila ay maprotektahan. Ayaw na mpo namin siya kasama sa bahay namin, bahay po yon ng aking ina na nasa abroad. Ano po gagawin namin?" Ang payo ko sa kanya ay kumuha agad siya ng BPO o Barangay Protection Order. Once na magrequest ka sa kapitan ng barangay ng BPO, ito ay kailangan agad na i-issue. Ayon sa Republic Act No. 9262 otherwise known as Anti-Violence Against Women and Their Children Act, ang isang babae o anak nito ay may karapatan na kumuha ng barangay protection order sa kanyang barangay captain laban sa asawa, ka-live in o karelasyon. Ang barangay protection order ay binibigay ng kapitan o kung wala siya ng isang kagawad ng barangay, sa babae at anak nito na biktima ng physical abuse o psychological abuse laban sa asawa, ka-live in o karelasyon. Itong order na ito ay nababawal sa lalaki na lumapit, pumunta, makipag-usap o magpakita sa babae na may nakatakdang layo. Kasama dito ang utos ng barangay na i-harass, asaran, tawagan sa telepono o kontakin o makipag komunikasyon sa babae o anak niya. Inuutusan din ng barangay sa protection order na lumayo sa bahay na tinitirhan ng babae at anak nito ang lalaki, kasama na ang mga lugar kung saan nandoon ang babae o anak katulad ng workplace, school at iba pang lugar. Ang barangay protection order ay nagbibigay din sa babae ng temporary custody of a child/children to the petitioner. Ang barangay protection order ay enforceable at effective lamang for a period of fifteen (15) days. Kung gusto ng babae o ng anak na maging permanente ito ay kailangang magfile siya ng petition for issuance of permanent protection order sa Regional Trial Court na nakakasakop sa lugar ng babae o anak niya. Ang kapitan o kagawad ng barangay ay hindi pwedeng pilitin ang babae o anak na iurong ang request o makipagkasundo sa lalaki ayon sa SEction 33 ng RA 9262. SECTION 33. Prohibited Acts. – A Punong Barangay, Barangay Kagawad or the court hearing an application for a protection order shall not order, direct, force or in any way unduly influence he applicant for a protection order to compromise or abandon any of the reliefs sought in the application for protection under this Act. Section 7 of the Family Courts Act of 1997 and Sections 410, 411, 412 and 413 of the Local Government Code of 1991 shall not apply in proceedings where relief is sought under this Act. Ang lalaki na nag-violate o lumabag sa barangay protection order na binigay ng barangay sa babae at anak nila ay may parusang imprisonment of thirty (30) days ayon sa Section 12 ng R.A. 9262 at pwede itong isampa sa municipal trial court, metropolitan trial court, or municipal circuit trial court that has territorial jurisdiction over the barangay that issued the BPO. Violation of a BPO shall be punishable by imprisonment of thirty (30) days without prejudice to any other criminal or civil action that the offended party may file for any of the acts committed.
