ATTORNEYS AS THE MAD DOGS OF WAR A client put it well to me perhaps a decade ago. If the other guy was reasonable, Id settle it myself. What I need is someone to shove him around and make him reasonable. Attorneys sell power. No more, no less. They allow a party to use the courts and documents to achieve the ability to prevail against another entity or person...or to defend against someone trying to do just that. The courts are powerful tools, as discussed in other articles on this site and on our website (stimmel-law) and if one wants to bring in that type of control, the attorney is who you retain. A good attorney will advise and allow a client to achieve more power than that person was able to bring to bear without the tools of litigation. But that power is a two edged sword-the other party can also retain counsel and the chess game that derives, while fascinating, is also expensive and can be extremely destructive. A good attorney can use the courts. A truly good attorney knows how and when to use them. Sometimes you need the Dogs of War to be aroused. Sometimes you have to consider other alternatives. You just dont need a Dog of War. You need a smart Dog of War who at times should be on a leash. But its nice to know that such tools are available and sometimes...more often in todays somehow highly stressful business word...it is what is needed more than sweet reasonableness.
