Anne Phelps The GULAG Exists About three months ago, Gene Paulson from eastern South Dakota was arrested and placed in solitary confinement in the Brown County courthouse in Aberdeen. A little over a year ago, Gene, age 77 had a stroke and has been in a wheelchair. So what crime could be so heinous as to warrant a man in a wheelchair with limited mobility to be locked in solitary confinement with a $25000 cash bond? Why do the PTB fear this man? There is only one reason, Gene knows the law and he is willing to use it. A bit of history is in order to set the stage on this event. Gene was a farmer and agri-business man all of his life. He owned and managed an organic grain exporting business and this business grew to a point to be of interest to some very large grain corporations. He was chosen to be bought out by one of these conglomerates but Gene was not interested in selling. He didnt think he needed to be concerned because he was well leveraged against his business. Soon thereafter he started to become embroiled in legal disputes. Gene had taken a legal seminar from Gene Zimmerman, an expert in legal philosophy. Gene won the first few skirmishes in state court using legal procedure. Then the same legal procedure failed him as he began losing case after case. We can only speculate what caused the change. The justice system then told Gene he was not allowed in state court unless he hired an attorney or asked and received permission to bring suit. Gene then took a more unconventional approach to his situation. He re-read the constitution and in particular the Bill of Rights. The Bill of Rights in the constitution was made a requirement before the constitution would be passed into law because the founders of this nation did not trust the government. The Bill of Rights is specifically for the people and was written in language so plain so as not to need interpretation. The 5th article states that the people have a right to form a grand jury. So also did Supreme court justice Scalia in 1992 in a case entitles US vs. Williams (Google this). Scalia states that while it is under the normal function of the court to do the (jury) it is in the complete prerogative of the people to form their own juries. So we did. We formed grand juries in several states and along with them 7th amendment juries to deal with civil matters such as foreclosures. We worked on void judgments (Google that) on several foreclosures. For any contract to be legal, there has to be at least four requirements that form the essence of a contract. 1) is a piece of paper (contract) 2) two signatures on the contract 3)money needs to change hands (that promissory note you alone signed is a check that you give to the bank. it comes out of your mortgage) 4) full disclosure . They need to tell you where the money came from. Im sure they didnt tell you it was yours. If anyone of the four elements is missing, the contract is void. And so it has to be in the complaint or the complaint lacks standing to go into court. If the complaint lacks standing, the court has no jurisdiction to take the case. If the court takes the case without jurisdiction, that is called judicial fraud. It is a serious crime. And sometimes the jury on seeing this, will convene into a 5th amendment jury and indite the judge. Maybe that is why the judges in South Dakota are so upset. And now we have a man in jail who could be out. The system wants him to cop a plea. He wants his day in court. He wants to prove the bill of rights is still in effect today. It is merely being not used. The judicial system has denied him access to the state courts. While he was in jail, his wife was told she could not use the federal court. This spring Gene had a case go to the 8th District Circuit Court of Appeals. His next step was the United States Supreme Court. The question there is the same as here in South Dakota: Are the decisions of a 7th Amendment Jury valid? Gene was using assets based on 7th amendment juries to offset bankruptcy liabilities. He had started the process of filing papers for the US Supreme Court. While in jail, a prisoner has to have all the resources he requires to prove his case. He was given a pencil and a piece of paper. It is pretty hard to do a Supreme Court case with a pencil and a piece of paper in solitary confinement. Coincidence? Does the state want to suffer a man in a wheelchair into submission? Genes lawyer is a servant of the system. He wont do anything that may run counter to the judge. We cant help Gene. We will be right beside him if we assume the rights of an attorney. They only allow those in their system that play by their rules. I am of the persuasion that if a man sees something wrong, he should do something about it. If a man sees something wrong and fails to do anything, he participates in the wrong. That is also a maxim of law. When we see evil and do nothing, we do something. When see evil and say nothing, we say something. Maybe that is why the country is in the condition it is in. The decline of a nation has been documented to include several steps. It will go from tyranny to war. From war to a new beginning, excitement, anticipation, then to complacency and then to apathy. From apathy it is a short step to tyranny. And so it goes. Where are we? Is this why there is a major push for taking our guns? Is this the reason one cannot find ammunition for the guns? The powers that be know this cycle more than we. They are doing everything in their power to control it. When we look at the technology for destruction, the intrusion on our information, the drones, the exploding bullets, we think we dont have a prayer for freedom. Not so. Those people who control a majority of this technology are not all bad. We have to count on the conscience of those whom we have entrusted with our trust. We have to believe that many of them still had good moms and dads who instilled in them a conscience and hopefully more, a respect for God. Trouble is, we wont find out until the chips are down. There are only two sides to this fight. One is right. The other is not. And there are so many on the fence, it will soon collapse. Lets just hope and pray that most will fall on the side marked right. Are there any lawyers out there with enough balls to take this on? It will probably be your last case unless you have the backing of a big PAC who has deep pockets. I tried the ACLU. That bothered me but I tried. They said they were too busy. Oh well. Oath keepers? Never responded back. Do we need to have a court of public opinion. Isnt that what law is after all. Rules to protect people?
