At the resumed hearing of the consolidated suits before the court today, November 11, 2013, Olusola Oke Esq representing the PDP, sought leave of Court for extension of time to enable him file and serve his Respondents brief and to adopt the briefs already filed and served. This application was granted with effect from today. Thereafter, the application filed on August 7 2012 by Omehia asking the Supreme Court invoke S. 22 of the Supreme Court Act and sit as the Court of Appeal, was withdrawn by his counsel Udechukwu SAN and struck out by the Court having been opposed by Ricky Tarfa SAN, counsel for the Appellant in SC/111/12 and to enable the substantive appeal proceed.Chief Oke of the PDP vehemently opposed the first respondent ( Omehia) at the lower court but now at the supreme court has supported the first respondent a complete turn around. The question then is does he have that right? It is a point of law for the lawyers to argue and the court to decide. Meanwhile the case has been adjourned to February 7 for judgment.
