Azad Bharat ka itihas – Part 320 What is the crime of this innocent youth? Aziz Burney The day I received Deoband’s student Shahnawaz Qasmi’ letter, I started my search for the proofs that could lead to the release of Sajjadur Rehman. Obviously it was necessary to meet his family members in Kashmir and get information about him personally. Therefore, I requested my team in Kashmir to go to his home, meet his family members and get information about him and if they get any documents proving his innocent, to sent it to me so that I could present the documents to the state government of UP and draw its attention towards Sajjardur Rahman’s release. The most important document that I could get in this connection was the order of the The Court of Additional Sessions Judge/ Special Judge S.C/S.T. Act, Lucknow ( in jail premises) S.T. No. 1580 of 2008) which has clearly declared Sajjadur Rehman acquitted of the charge that the police had framed against him. Therefore I am publishing the copy of the order of the honourable judge. Sajjadur Rahman was present in his educational institution in Deoband on the dates the police has alleged him to be involved in bomb blasts. In this connection the letter issued by Darul Uloom Deoband which is in our possession proves that the charges leveled against him are false. I am including the letter alongwith Shahnawaz Badr Qasmi’s letter and the report sent by our Kashmir team and other proofs in today’s writing. I do not need to say anything further today. All the evidences prove his innocence and the tortures meted out to him. Here is Shahnawaz’s letter and on the next page with other evidences and the report received from Kashmir. In the name of Allah the most merciful What is his crime? A letter about the student of Darul Uloom Deoband Maulvi Sajjadur Rahman arrested on the charges of terrorism to the editor of the Azizul Hind, Mr Aziz Burney. Janab Aziz Burney, Assalamo alaikum, I want to draw the attention towards an incident that has stirred my whole existence. I think that even the Urdu media did not pay attention to it. After all, what is the crime of this innocent student arrested on the charges of terrorism since the last five years? Is the Kashmiri being punished for being a Muslim and is there no one to help him get justice? The details of the serial bomb blasts in the court complexes of Lucknow, Faizabad and Varanasi have come in the media. Immediately after the blasts the two accused Maulana Khalid Mujahid (now deceased) and Tariq Qasmi were arrested by the team of the intelligence agency (ATS) and they were tortured to extract confession. The details of all this have come in the media by their family members and by the Nimesh Commission report. But the case of Maulvi Sajjadur Rahman belonging to Gupanchal in Kishtawara in Kashmir who was studying Arabic in the 7th year in Asia’s largest seminary Darul Uloom Deoband was arrested in the same case. But since his arrest there has been no report or investigation on him till date. The most painful part is that despite repeatedly drawing the attention of the Muslim organizations towards this case, they did not think it appropriate to pay attention to this orto come forward to help him. It should be noted that Sajjad Kashmiri’s father Ghulam Qadir Wani is a poor labourer and cannot afford the money to travel to Lucknow, Delhi or Deoband to prove the innocence of his son. After the bomb blast, Sajjardur Rahman was arrested when he had gone to his home Gopanchal during his Bakr Eid vacations. According to his father, Ghulam Qadir, the very next day after Baqr Eid some policemen from the local police station came to his house and asked where Sajjad was. At that time, Sajjad had gone to meet his relatives. In the evening, I took my son along with me to the police station and asked the reason for calling him. The thana incharge told him that it was the order of the higher authority. After that, the police took him to the district headquarter and the next day the police gave the statement that a big terrorist was arrested from Kashmir. Since that day, Sajjad has not returned home. According to the police, he is accused of being in touch with the persons involved in the bomb blasts and was an accomplice in the conspiracy. Sajjad Kashmiri is in jail for the last five years in spite of all the proofs of his innocence and there is no one to take care of him. The biggest proof of his innocence is that the attendance register of Darul Uloom Deoband shows not a single day of his absence in the month the blasts occurred. Secondly, Sajjad never visited the towns where the blasts occurred. Sajjad Kashmiri’s arrest was made after the police asked Khalid Mujahid if he knew any Kashmiri. Khalid took Sajjad’s name and told him that he knew him because of the Al Ahrar magazine and that he had met him only once in Deoband. Three months ago when the Akhilesh government announced the innocence of Khalid Mujahid and Tariq Qasmi according to the Nimesh Commission report, I thought that the innocent student Sajjadur Rahman will also be released very soon. But my hopes came crashing down when the Allahabad High Court rejected the recommendation of the UP government saying that the evidence produced before the court were insufficient and such decisions will only encourage the terrorists. I have a question to the judges who have pronounced the judgment: The present government has found the accused innocent on the basis of the Nimesh Commission report set up by the former Mayawati government. The recommendations were made after that. Who are the terrorists that have received encouragement from this? It is beyond understanding. The police in this country does not arrest the real terrorists and the communalists but the court feels insulted in releasing the Muslims who have been found innocent. Is it justice? According to the investigation, Sajjadur Rahman has been acquitted by the court in the case three and a half years ago in 2011 after the UP police arrested him as the intelligency has not been able to prove the charge. But Sajjad has been framed in two other cases after that. Now only God knows how many years he will take to prove his innocence. According to Sajjad’s father, the girl he was betrothed to has been waiting since. But now it seems her wish can never be fulfilled. According to Ghulam Qadir, he is more worried about his well being after the custodial death of Khalid Mujahid and wonders if there is a threat to his life. Janab Aziz Burney, I am submitting whatever proofs I could manage along with Sajjad’s letter written from jail immediately after his arrest which will expose the conspiracy. One cannot believe the modus operandi of the intelligence agency to brand Sajjad a terrorist. Can one be branded a terrorist only on the basis of being a Kashmiri? You can understand the pain and trauma his family is going through. Janab Aziz Burney, I felt the need to write this letter to you when I saw that no one is paying any attention to the case of this innocent Kashmiri. I know that you are fighting for the rights and justice for the Muslims of this country through your writings and speeches. Therefore, I thought it necessary to draw your attention towards this. Please go through all the facts and evidences and decided what is right and what is wrong. Please bring the truth before the public through our esteemed daily Azizul Hind. If your efforts bear fruit and this innocent youth gets justice and his innocence is proved, it will be a great favour not only to the family of Sajjadur Rahman but to the Muslims of India. Thousands of innocent Muslims like Sajjad are forced to spend their life in the confinement of jails all over the country and there is no one to take care of them. I request you to come forward to get them justice. The community is with you. May God facilitate the release of all the innocent people and establish peace in the country. Ameen.
