‘‘(B) ADDITIONAL FEE.— ‘‘(i) IN GENERAL.—In addition to the 20 fee required by subparagraph (A), a registered employer, at the time a W nonimmigrant commences employment in the registered position for the registered employer, shall pay an additional fee for each such approved registered position as follows: I) A fee of $1,750 for the registered position if the registered employer, at the time of filing the application for the registered position, is a 5 small business and more than 50 percent and less than 75 percent of the 7 employees of the registered employer 8 are not United States workers. 9 ‘‘(II) A fee of $3,500 for the registered position if the registered employer, at the time of filing the application for the registered position, is a 13 small business and more than 75 percent of the employees of the registered 15 employer are not United States workers. 17 ‘‘(III) A fee of $3,500 for the registered position if the registered employer, at the time of filing the application for the registered position, is not 21 a small business and more than 22 percent and less than 30 percent of the 23 employees of the registered employer 24 are not United States workers.
