Because english common law believed women to be morally superior to men, and did not consider them capable of criminal mentality. They could be found guilty but only if their actions were in the company of a man. This ended with womens riots in the early 1600s during a famine. The women stormed merchant ships and took food that was going to be sold to other European countries, also experiencing drought, at a great profit. The women paid what they believed the stolen goods to be worth and distributed the food equally amongst the women and families. They effectively risked their life and liberty for the possibility to continue living. From that point forward mens rea would applied to women as well as men....
