Business has been brisk this year. Great for me, but unfortunately, my business is often good because of other peoples legal woes. For example, during the past couple of months Ive had three clients come in whose spouse had just passed away. They expected to be able to do a simple affidavit to file with the county recorder to establish their spouses death, and show ownership of their joint owned property solely in their own name. However, upon examination of their current deeds, we discovered that vesting was not indicated. In other words they did not own their property as husband and wife as joint tenants, or husband and wife as community property with right of survivorship. They all ended up having to do a probate procedure to acquire full ownership of their own real estate. If you are married and own property with your husband and you want to make sure you will not need any type of probate procedure when your spouse dies, its a good idea to look at your deed and make sure the vesting is correct.
