CAT issues notice of contempt to Director, PGI for 14th January Chandigarh 3rd December, The PGI Medical Technologists Association had filed a civil writ petition No. 7071 of 1995 in the Hon’ble High Court on 14th May, 1995 against the wrong pay fixation and postponing of date of increment of Permanent Research Cadre employees under the 4th Central Pay Commission w.e.f. 1.1.986 while revising their pay scales in 1994. In November, 1995, I, on behalf of Association, argued the matter before the Division Bench of Hon’ble High Court. The writ petition was admitted. In 2013, the writ petition was transferred to Hon’ble CAT, Chandigarh since the PGI came under its jurisdiction. On 30.8.2013, the Hon’ble CAT, Chandigarh was pleased to direct Director, PGI to place the matter before the Standing Finance Committee / Governing Body of PGI for their consideration and pass speaking and reasoned orders within 3 months i.e. on or before 6.12.2013. The Director, PGI had violated the orders and directions of Hon’ble CAT with impunity. Neither the matter was placed before SFC /GB, which hold its meetings during 2013-2014 and did not pass appropriate orders nor it sought any extension of time from the Hon’ble CAT, Chandigarh during the last 15 months. On 24.11.2014, the PGI MTA resolved to file a contempt petition and authorized the undersigned to file and plead contempt petition for and on behalf of Association. The Contempt Petition No. 0060/00221 of 2014 filed by Association came up for hearing today. The Hon’ble CAT, Chandigarh has been pleased to issue show cause to Director, PGI and the next date of hearing has been fixed for 14th January, 2015. (Ashwani Munjal) General Secretary
