CONSUMER TIPS The Sale of Goods Act Many consumers are unaware that there is a list of consumer legislation available to protect them. One of the seven existing Acts available to protect consumers is the Sale of Goods Act No. 37 of 1895 as amended. The aim of this Act is to guide both the buyer and the seller as to the terms and conditions that govern a contract for the sale of goods. It applies to contracts for the sale of all types of goods. The following important points are outlined in the Act. Consumers, you must pay attention to ALL Conditions and Warranties. The goods must correspond with their description when there is a contract for the sale by description. The goods shall be reasonably fit for the purpose for which it is bought and must be of merchantable quality. The goods must correspond with the sample. Consumers, you MUST examine the goods. The buyer must have a reasonable time to examine the goods when they are delivered, before he accepts them. This will give the buyer the opportunity to determine whether the goods are in conformity with the contract. Consumer, the seller has rights if he is not paid. The right to retain goods for the price while he is in possession of them; In the event of bankruptcy of the buyer a right of stopping the goods in transit after he has parted with them; A right to resell the goods; and A right to bring action against the buyer for the price. Consumers, you may maintain an action against the seller if goods are not delivered. Where the seller wrongfully neglects or refuses to deliver the goods to the buyer, the buyer may maintain an action against the seller for damages for non-delivery. Where a seller breaches a warranty, the buyer is entitled to maintain an action against the seller for damages for the breach. Consumers, you have the right to acquire the knowledge and skills to be an informed and assertive consumer. Remember, the power is yours.
