The factions are vying with each other over the death of the 23-year-old. While the Haryana Pradesh Congress Committee (HPCC) chief Phul Chand Mullana and local MLA Vinod Sharma attended the cremation of the deceased with Sharma announcing an ex-gratia grant from Rs 2 to 5 lakh, Union Minister Kumari Selja from the dissident group was quick to reach Kumars residence to express her condolence with the family at Ravi Dass Majri. Selja on reaching the city on Thursday also had a close door meeting with the Deputy Commissioner K Makrand Pandurang and Sub Divisional Magistrate Vinay Partap Singh at her residence. She criticised the state government for not providing protection to the Dalits. She said that police are committing atrocities on Dalits and that the incident is one such example. She also demanded a CBI probe into this case. Ravi Dass Majri villagers who had earlier blocked police post no. 2 on Tuesday, on Thursday demanded the kin of the deceased to be given employment in government service. Meanwhile, on expiry of one-day police remand, the three cops —ASI Satbir Singh and constables Dalbir Singh and Parkash Chand—were produced in a court where they were further remanded in two-day police custody. Following agitation in front of police post, police had booked all the three cops for murder of Ram Kumar whose body was found on the railway track with hand cuffed and fettered. Ram Kumar and one Vikas were illegally detained by the police on Monday night for theft charges. While the formers body was found on the tracks on Tuesday morning, Vikas only returned home in the evening. He is at present admitted to Civil Hospital, Ambala. Assistant sub-inspectors Satibir Hooda and Dalbir Singh and head constable Parkash Chand were produced in the court of chief judicial magistrate, who remanded them in police custody for a day. The director general of Haryana police has also entrusted the probe into the case to state crime branch. Police commissioner Rajbir Deswal said the probe has been transferred to ensure free and fair investigation. Vikram, who was also picked up by police along with Ramu, a resident of Ramdasia Majri area, on Monday night, returned home and narrated the horrifying experience he and Ramu had in the illegal custody of the police. Even though he is yet to get his statement recorded before the judicial magistrate, Vikram alleged that the policemen first kept them in illegal custody and then prompted them to flee. He also alleged that one of the cops had pushed Ramu before a moving train. All this happened before me and fearing for life I hid myself in a field nearby, Vikram said. The Ambala police had taken Ramus body to PGIMS Rohtak for autopsy to ascertain whether he was drunk before the incident. Even though a magisterial probe has been ordered into the incident, residents of Ramdasia Majri did not allow police to come to their area on Wednesday till Ramus body was brought here from Rohtak hospital. The colony residents are guarding Vikram and insisting that his statement be recorded at his residence after other community elders return from the Rohtak hospital. Ramus mutilated body was found on the railway tracks on Tuesday morning hours after he and Vikram were picked up by Ambala police for allegedly creating nuisance in the area. Acting on a complaint by Ramus father, police had registered a case of wrongful confinement, murder and destroying evidence against three policemen. High drama was witnessed on Wednesday in the colony when police tried to take Vikram to police station, but the family members did not let the police enter their area. CUSTODY DEATHS December 2007: Joginder of Shahbad, who was picked up by the CIA staff for questioning, died in custody at Panchkula police station. Police registered a case against seven policemen who were also taken into custody. All of them were exonerated February 2011: Subhash Saini alias Billu, who was picked up for questioning by policemen, was found hanging in the lock up at Hansi police station in Hisar district. Following a magisterial probe, a case was registered against the then SHO and other policemen on duty. But the investigation found that Subhash had committed suicide February, 2012: Siblings Bhaskar and Sachin were found dead on railway tracks after they were picked up by Jagadhari police for questioning. GRP claimed the duo was knocked down by Howrah Express but their family alleged that they were eliminated by cops. The compensation was given as per G.O Ms No. 3 issued by the Social Welfare Department in 1996 to enforce rules framed in the SC & ST (Prevention of Atrocities), Act 1989. District Collector S. Suresh Kumar distributed cheques of Rs.50,000 each to the 157 men and women at a meeting held at the Social Welfare Department office on October 10 after the case was charge sheeted at Special Sessions Court in Guntur. Superintendent of Guntur Rural, J. Satyanarayana and president of Indian Dalit Women Association , G. Rajasundara Babu, who has been galvanising public opinion and fighting a legal battle in this case was also present. The incident had taken place on May 17, 2003 at Pedamakkena village. A meeting convened by a few Dalit leaders, police and revenue officials on the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 raised the hackles of upper castes, who ‘socially boycotted’ the Dalit families. In the following days, Dalit men and women were denied work in the fields and houses of upper caste families. Shops selling provisions, medicines shut the doors on the Dalits . Many Dalits were forced to leave the village and seek work in distant villages and towns. After persistent efforts by the IDWA, an enquiry by then Chairman of A.P SC & ST Commission Justice K. Punnaiah was held and a case filed in Sattepalli Rural Police Station against the accused under Section 3 (1) (6) & 3 (1) (10) of Sc & ST (POA) Act with a mandate to the DSP to file the charge sheet within 30 days. But after a year, then DSP K. Veerabhadra Rao filed a memo stating that the case was a non-cognizable offence forcing the victims to file a case in the court of Additional Munsif Magistrate, Sattenapalli to take action against the eight accused under Sections 3 (1) (10), 3 (1) (6) and 3 (1) (14) of SC, ST (POA) Act. Later the case was committed to the Special Sessions Court, Guntur which framed the charges in August 2009 and recorded statements from 13 persons directly and 157 persons filed joint affidavits. In 2011, the district administration sought clarification on the payment of compensation from the Government and the Special Public Prosecutor since the case was private. But the court opined that victims filed the case as per the alternative procedure laid down in the Cr. PC giving the nod for further proceedings on the trial. Finally, the Social Welfare Department gave the nod for payment of compensation to the victims raising their hopes for justice. But their fight is not over yet. District secretary of TNUEF P Vanjinathan said, “The team conducted survey at 47 villages in the district for a period of about one month. After finding that discrimination against Dalits is still prevailing at some villages, we have submitted a petition to the Collector and sought action.” In the petition, they have listed six villages where double-tumbler system is in practice. “Double-tumbler system is prevailing in tea-shops at villages such as Jayangondapattinam, Kalgunam, Odakkanallur, Pazhanjanallur, Kurungudi and Su.Keeranur. Apart from this, at Kalgunam and Thathampettai villages, Dalits have not been allowed to cut their hair in the barber shops that are common for all,” he said. At Vengadampettai and Erumanur villages, Dalits could not take part in the auctions for fishing in ponds. “Also at Yerumanur village, which is about 6 kilometers from Vriddhachalam, Dalits were not allowed to sit on the bench even in a small hotel. They have to sit on the ground,” he added. The organisation also said in the petition that Dalits could not put towel on their shoulders at Mamangalam village, while walking through the streets of upper caste. “We want the Collector to take action against these discriminations immediately. If he fails, TNUEF will hold protests,” Vanjinathan said. CPM district secretary T Arumugam was also present while submitting the petition to collector Kirloshkumar. Disclosing this to media persons here on Wednesday, Minister for Social Welfare H. Anjaneya said that the proposed Bill will ensure allocation of funds to both the section in proportion to their population. On becoming law, it will ensure total utilisation of funds allocated to these sections in the pla-nned budget. “The Bill is being tabled, as the funds are not being utilised or are being diverted. The Law Department is providing the final touches to the Bill,” he said. On the inordinate delay in according community rights to tribal people in the State, the Minister said that a Cabinet sub-committee comprising high-level officials of forest, revenue and social welfare departments has been set up. The government is awaiting a report from sub-committee to take action to accord community rights to tribal people in accordance with the Forest Rights Act 2005, he added. Mr. Anjaneya said that the government was keen on opening social welfare offices in all taluk headquarters and filling vacant posts in the department. “The government has earmarked Rs. 2,480 crore in the budget for the uplift of tribal people under the Tribal Special Component Plan,” he said. The government has earmarked Rs. 125 crore to provide basic amenities in tribal settlements and Rs. 25 crore for the construction of Valmiki Bhavans. Regretting that money earmarked for the uplift of Scheduled Tribes had not been utilised by the BJP government, he said that the Congress government will take steps to spend the money allocated by both the Union government and the State. He said that the Maharshi Valmiki Jayanti will be celebrated on a grand scale at the Banquet Hall of Vidhana Soudha with Chief Minister Siddaramaiah inaugurating the event. “A selection committee will finalise the Valmiki award by Thursday,” he said.
