Darrell Flyingman - The Flyingman Initiative 21 hours ago In a statement made today by Darrell Flyingman, Flyingman wants tribal members to know that he is not, nor has he ever been in support of the pokertribes contract. This is a lie made up by Richard Grellner in his motion to the court (below). Flyingman has never made a public or private statement in support of this contract. As for comments and documentation about Richard Grellner that have been published in The Flyingman Initiative, facebook page or The Cheyenne - Arapaho Tribal Council page - comments made by our readers are protected under freedom of speech. We stand for unity among the tribes. Grellner apparently used comments and documentation published by these two pages as his excuse for withdrawing and closing a case that should have never been made by him on behalf of the Cheyenne and Arapaho tribes. We are not the dysfunctional, unsophisticated and easy targets Grellner said we are in an interview by Murray Evans in 2011 (see post). _______________________________________________________ IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF OKLAHOMA CHEYENNE ARAPAHO TRIBES OF OKLAHOMA Plaintiffs, v. Civil Action No. 13-1355-D SALLY JEWELL, et al. Defendants. MOTION FOR LEAVE TO WITHDRAW AS ATTORNEYS FOR PLAINTIFFS The undersigned respectfully request that this Court grant them leave to withdraw as attorneys for the Cheyenne Arapaho Tribes of Oklahoma (“Tribes” or “CNA”) pursuant to Rules 7.1 and 83.5 of this Court’s Local Rules. The grounds for the request are as follows: 1. On December 26, 2013, the undersigned filed suit against the Secretary of the U.S. Department of Interior (DOI) at the request and direction of the Tribes’ Governor, Janice Prairie-Chief Boswell, with every indication the litigation also enjoyed the support of Eddie Hamilton, who at the time was expected to become Governor in January 2014. 2. However, the subject of the lawsuit – an online gaming website intended for an exclusively international market called pokertribes – became a political football in the tribal electoral season. A former Governor (who purported to run for the job in an uncontested parallel “election”), and other third parties alleged that the Tribes’ investment in developing the website – which marketing studies have projected could bring the Tribes gross annual revenue of some 130 Million Dollars by 2017 – was improper; and suggested that successful negotiations with the State of Oklahoma to clarify the terms of the existing Tribal-State Compact to permit online gaming to an international market somehow jeopardized the Tribes’ existing gaming operations. 3. The former Governor also mounted online personal attacks against tribal officials – including members of the CNA Gaming Commission headed by Eddie Hamilton’s father Walter Hamilton – and representatives who had worked on behalf of the Tribes to bring the project to fruition. 4. These online attacks apparently persuaded former proponent Eddie Hamilton to disavow both the project and the federal lawsuit challenging action by DOI to obstruct commencement of operations. Ironically, the former Governor then proceeded to express support for pokertribes. - 5. To further complicate the question of legitimate executive authority, the Regional Director of the Bureau of Indian Affairs, wrote the Tribes in February 2014 regarding funding of contracts for tribal programs, noting that “[a]s a result of that [leadership] dispute, the Region is aware of three persons claiming to be the rightful Governor of the Tribes” (emphasis added), Terry M. Bruner to Governor, Cheyenne & Arapaho Tribes, February 10, 2014 (Attachment), p. 1; and informing the Tribes in relevant part that “the Region has looked closely at this situation and determined that it is not necessary for the purposes of these direct program funds and contract support funds to make a tribal leadership determination at this time.” Id., p. 3. 6. The Tribes’ Constitution provides that a sitting Governor continue to serve until a replacement is duly sworn. The Regional Director’s mention of “three persons claiming to be the rightful Governor ...” was in likely reference to Ms. Boswell’s claim to continuing authority as Governor under this constitutional provision. 7. The undersigned have been reluctant to take any action without agreement, or at the least consensus, between and among the potential Governors, including especially Ms. Boswell, whom they regard as most likely to have current executive authority under the Tribe’s Constitution. 8. Ms. Boswell has now decided that, while on a personal basis she favors continued prosecution of the lawsuit with the assistance of undersigned counsel, she is reluctant to ask them to continue in the case absent more definitive indication that she indeed has the requisite executive authority to do so. The undersigned thus feel bound to seek leave to withdraw at this juncture. WHEREFORE, the undersigned respectfully request leave to withdraw their appearances as attorneys for the Cheyenne Arapaho Tribes of Oklahoma. A proposed Order is attached.
