Democracy vs. Islam There are 3 types of authority (Sultah). 1- Sultah Tashreeiyyah - legislative authority. This is the one who decides what is legal or illegal, liable for punishment or reward, and the rules for managing the affairs of the people. In democracy, parliament legislate/make laws for the state. In Islam, only Allah legislates He does not share his Hukm with anybody [EMQ 18:26] 2- Sultah Tanfeeziyyah - Executive/administrative authority. This is to be in authority and implement the laws legislated by (1) the legislative authority. In democracy, The Prime Minister/president, ministers, cabinet, mayors, councils etc lay down budgets, policies and decisions to administer or implement whatever laws the parliament lays down and cannot introduce his own laws by himself without parliament. In Islam, the khalifah, governors and their deputies etc do the same except they implement the laws laid down by Allah not a human legislator like parliament. Allah (swt) says, Rule and judge by whatever Allah revealed and do not follow their desires. [EMQ 5:49] 3- Sultah Qadaaiyyah - Judicial authority. This is the appointed judges and courts that remove the disputes of the people through arbitration declaring judgements between them based on what the law of (1) legislative authority has legislated. In democracy, the courts judge based on whatever the law of parliament says about the disputes between people. Judges cannot legislate or amend laws even if he disagrees with it. In Islam, the courts judge based on whatever Allah legislated only and not a parliament. The one who judges by man made laws is a Taghoot and going to him for disputes is Shirk in Allah. Allah (swt) says, Have you seen those who falsely claim to believe in what was revealed to you and revealed before you and yet they willingly seek judgement from the Taghoot?
