Then I Also Received This Email From Admissions Dear Student: Based on the information you provided on your admission application, you are classified as a nonresident student for tuition purposes. Read this letter carefully, as it contains information on your residency status and instructions on how to change your nonresident status to resident; and how to apply for an exemption of the nonresident tuition (AB540). Due to budget constraints, we have very limited staff, and do not evaluate residency on the phone. California residency is determined for tuition purposes each time you apply to Cuesta. Residents pay the resident fees and nonresidents pay the nonresident in addition to the resident fees. A resident is a student who has established both physical presence of one year and a day prior to the start of the semester, coupled with the intent to make California the permanent home. Anyone who is married or is 18 years of age or older may establish California residence. Ø You can only be resident in one State at a time. If you establish residence in a different State, you relinquish your prior residency. Ø A man or woman need to establish his/her own residence. Your residence cannot be derived from that of your spouse. Ø Your residence can be changed only by the union of act and intent. Ø You can only establish California residence if you are a citizen, legal resident of the U.S., or have a visa that will enable residency for tuition purposes. Ø If you are a minor or are dependent on your parents, you take the residence of your supporting parent. Ø To establish your residency, you will need to prove financial independence in accordance with Education Code, Section 68044. Ø If you are under 18 years of age and live with a guardian who is a California resident, you can be classified as resident if you have lived with and been under the continuous care and control of your guardian for at least two years prior to enrolling. A non-resident student is defined as a student who: Ø has not had legal residence in California for more than a year and a day prior to the first day of the semester, and Ø has not demonstrated intent to make California his home, and Ø has not met the other necessary State residency laws. For information on tuition and fees, refer tocuesta.edu, click on Current & Future Student, Get Started, Fees. Exceptions and Exemptions to the residency laws: A. State laws allow for an exception of the residency regulations to students who do not qualify for residency at this time, but who meet one of the following criteria. To apply for an exception, you need to complete and submit to Admissions a Statement of Legal Residence form and attach the pertinent documentation. See below for information on how to access this form. Ø Currently involved in the military or dependent of a person in the military whose home of record is CA, or who is in active duty in CA: submit copy of your military order and/or DD214. If you are a dependent of the military person, submit your dependent I.D. card also. Ø Credentialed employee of a California public school or full-time employee of a California Community College, UC, or CSU, or a dependent: submit letter from you employer. If you are a dependent of a full time employee of a California Community College, you need to provide proof such as your parents’ most recent income tax return, or any other verifiable form of proof. Ø Seasonal agricultural worker for the past two years or a dependent: submit letter from your employer. Ø Ward of the State of California: submit letter showing your guardianship. B. State laws also provide an exemption of the nonresident tuition based on Assembly Bill 540. This exemption is not available for persons who are absent from California but taking distance education classes from a California community college. To qualify for this exemption you must meet the following criteria: Ø Attended a California high school for a minimum of three years. Ø Completed high school in California and obtained a diploma, GED, or High School Certificate of Proficiency. Ø To apply for this exemption, complete a California Nonresident Tuition Exemption Request form. Ø Submit your official high school transcripts. For Previous California Residents: School and State policies require that you provide proof of your residency if any of the following applies to you: Ø You consider yourself a California resident, but have been recently absent from California for temporary periods of time, and have not established residency in another State or country. Ø You attended a school that is not in a California school district , or a college that is not in California. If you were classified as nonresident, and you consider yourself a California resident, you may request to have your residency reevaluated. For a residency reclassification, complete and submit to Admissions a Statement of Legal Residence form and attach pertinent documentation to support your California residency, i.e., high school or home school information on letterhead showing the name and location of the school; proof of nonresident college tuition paid in an out-of-state college; and/ or other pertinent information as listed on the Statement of Legal Residence.
