EMAIL FROM MEMBER RE: FATHER TAKING ME TO COURT FOR BREAKING COURT ORDER, WHEN HE LETS CHILD DOWN: I just wondered what advice people could give regarding my situation. When my little boy was 6 months I had his dad arrested for domestic violence and he was convicted. We went through court regarding contact and around his 2nd birthday he was granted contact out of a contact centre 1 day a week via a court order. However since then he has let him down several times, usually giving less than an hours notice so hes left disappointed, His usual excuse is that hes ill, but hes always at work the following day with no symptoms (one time claiming to have food poisoning). I have allowed him to swap a couple of sessions and hes had a complete no show (saying he thought the whole rota had changed when he swapped just 1 day). I have been quite fair, allowing him extra contact last christmas, inviting him to her 2nd birthday (which he didnt come to) and letting him attend her 3rd birthday (which he didnt arrive at until well over half way through). After one cancellation I told him that he needed to call and tell him himself instead of using me to deliver the bad news and that it wasnt fair on him cancelling so close to pick up time. If he didnt then I would cut his hours down to twice a month so that he might find it easier to stick to. However he cancelled last minute again and so I changed it. My little boy is now at pre school every day and so the other day he had would have needed to stop anyway, but he doesnt think its fair saying that I should cancel that day at nursery and he should see him. Recently he claimed that he couldnt afford to buy anything for him to eat when he went there, so I cancelled as he couldnt go there and go hungry. Hes now saying that hell take me back to court for breaking the order, but he doesnt seem to get that he has broke it several times anyway. What would other parents do and am I within my right to cut him down for breaking it? Thanks
