Easier said than done. Few people have the language and/or technical skills to decipher the S&P. Most of the time, especially if it is a development project, they are given a standard S&P prepared by the lawyer who also acts on behalf of the developer. The legal profession has failed to act on this prevalent conflict of interest. The one time when I, as the purchaser who pays the cost of the S&P, modified a standard S&P to make it favourable to the buyer, the solicitor who acted on my behalf failed to understand and explain the document to me adequately. Consumer rights awareness and protection is very poor in the housing industry.
