Mark Herring Office of the Attorney General 900 East Main Street Richmond, VA 23219 (804) 786-2071 December 3rd, 2014 Dear Attorney General Herring, I trust this letter finds you well and I hope you enjoyed a nice Thanksgiving with your family last week. I write to you, as a very concerned US citizen and taxpayer. The lawlessness of this current administration is beyond out of control and is posing a clear and present danger to our national security. Mr. Obama does not have the authority or the right to issue an executive order bypassing the legislative process of congress. It is a clear breach of the constitutional limitations and separation of powers. It is one more, in a growing and very long list of grievous and I dare say, probably even deliberate attempts, to usurp our constitution and the rule of law in our nation. I trust I don’t have to run down the whole list of constitutional breaches Mr. Obama has orchestrated as president of the United States, who took an oath of office, swearing to uphold and defend the very constitutional laws that he has subsequently turned around and proceeded to try to dismantle. The very last thing, he is doing, is upholding and defending our constitution, which as you know, is the core responsibility of any elected official of the United States of America. I don’t think I need to remind you that the United States of America is founded by our constitution, which by law, is and always will be, the supreme law of this nation. No law or executive order or Supreme Court ruling that runs counter to our constitution, is therefore lawful and subject to nullification. It is also unlawful for any person occupying the executive office, right or left, black or white or green, to legislate. The constitutional duty of the executive office is to enforce the laws, not write them. It is equally unlawful for the POTUS to circumvent the checks and balances of power that are deliberately designed so as to limit the accumulation of power into one of our governing branches. Not to mention the usage of the IRS to target political opponents, also unlawful. I could go on and on but I will not. I am sure you get the point. Today 16 states joined together to sue the president over this unconstitutional over-reach and breach of the separate of powers. I would like to know why Virginia is not one of them. Are you not responsible for upholding and enforcing the law? Is not the constitution the supreme law of the United States, including the state of Virginia? I don’t know about you, but I have grandchildren whose future very much concerns me. I do not wish for them to grow up in a lawless, chaotic, environment that unenforced constitutional laws will eventually lead to. I trust you also care about your children and grandchildren, do you not? I hope that you too care about the future of our nation, and our children. I hope that you are courageous and firm in your resolve to protect our great nation from all enemies foreign and domestic. And if you are not, I would like a written response and logical justification for your refusal to enforce the constitutional laws of the United States of America. The United States of America is not a democracy but a constitutional republic and as such, it is not the majority that rules, but the rule of law - the constitutional ones above all. Please do your duty and enforce them by joining in with Texas, Alabama, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Mississippi, Montana, Nebraska, North Carolina, South Carolina, South Dakota, Texas, Utah, West Virginia and Wisconsin in their lawsuit against the unconstitutional breach of the separation of powers by Mr. Obama and his administration. Or otherwise, please explain to me, in writing what exactly it takes to get those responsible for upholding and enforcing the law, to actually do their jobs and enforce them? Thank you for your kind attention to this matter,
