Freedom of speech does not allow for slander, damaging, or false accusations. And if someone stops you from having free speech, this is not actionable as a constitutional violation unless they are the gubment but i wonder what positions are actionable... just curious. who is the government and who is not? where is that line drawn? are picket signs slander? i would say absolutely so! and yet, they seem to never be challenged. are mudslinging campaigns slander? i would think so. but there are two things in question here... the first amendment and the civil laws. i suppose the constitution is the doctrine behind the nature of the laws. the constitution isnt a law, only laws can be broken, but in passing an unconstitutional law, is where i believe trouble happens. what branch of government is in charge of making sure a law is constitutional? the house of congress i guess... but do they even follow the constitution? do they even read the proposed bills/laws? if they dont, laws get passed without proper review. how is the constitution protected? coffee talk.
