SUB : Corruption in Judiciary compelling me to think to end the life before the court & People of our Democratic Country should know the harassment & violation of human rights of common people due to huge corruption in judiciary . Respected Sir, 1) That my mother Smt.Udayprabha Bafna was a successful Farmer,& businesswomem .She constructed many godowns,house properties at Dahanu & Mumbai. 2) That my both brothers Pankaj & Pravin were harassing my mother on the issue of properties. My mother gave them their all legal share ie. 40 acres of land at village Aagwan stainless steel factory to Pankaj , Grass business to Pravin ,houses with all household articles,jwellary,cash etc. and seperated them in the year 1984. 3) In the year 1985 my mother executed a gift deed of N.A.Land & godown of 1 acre to me as I am the youngest daughter & 1 acre of agricultural land each to another 3 married sisters at village Sarawli,Tal.Dahanu. Again my both brothers created a very big issue on property and started beating my mother mercilessly to pressurise her to transfer all land properties of parents into their name which compelled my mother to lodge a police complaint against them. 4) That in the year 1986 I got married with Ajay Kakaria. But my both brothers not attended my marriage and joined the hands with my greedy in-laws & husband who since the day of my marriage deprived me for any marital relations till the said property is transferred into their name. Due to inhuman torture for 2 years I became the victim of tuberculosis and was admitted into hospital.Since then I was residing with my parents at Dahanu. 5) My mother become a patient of hyper tension and diabites. Hence she executed a will on 19.1.1990 and kept it in my bank locker.In said will she has specifically stated that her remaining land at Sarawli,house,jwellary,car ,cash would be solely belongs to me. When she was admitted into hospital in the year 1992 ,she stated my elder sister Smt.Sharmila Bora to look after me as she was very much worried about me. She also refused my brothers not to interfere in my stay at her house after her death. On 15.8.1992 my mother died. 6) As soon as my mother expired,my brothers snatched everything of my parents. They dispossesed me from the house and started selling everything of my parents. As I refused to give sign on power of attorny within 3 days of mother’s death, they scolded me in most filthy language and filed a false case against me in civil court at Dahanu by using the name of my father to claim the said land property gifted to me by my mother in 1985. (Case No. Being RN no.14/1993) . But they could not succeeded as it was in my name. 7) In the year 2002 ,we settled the issue of our property and it was decided that I should relinquish front side road touch 24 acres of land at Sarawli into my brother’s favor and against it I would be given backside 14 acres agriculture land owned by father alongwith one flat at Kety Nagar, cash etc. I was given possession of it and also given some cash and insisted to sign on relinquish deed. I requested his advocate Sandip Shah & to my father to incorporate the terms but they denied saying have faith hence I ought to keep faith on father. As soon as the said Deed was registered on 7.1.2003, my brothers backout from giving me the land and flat.Hence I published public notice in local newspaper that no one should interefere in my land at Sarawli and also file a case for cancellation of relinquish Deed before Tahsildar at Dahanu. That Pending the said case my brothers sold all land property to builder Vijay Shah & Seema Shah . The said Vijay Shah to avoid govt.revenue and my brothers to cheat me have joined the hands and the same advocate Sandip Shah filed a case for Vijay Shah & Seema Shah in Civil Court at Dahanu and obtained the decree of adverse possession in favor of Vijay Shah & Seema Shah within 4 months by his corrupt practises and fraud upon the court. As soon as I came to know this fraud, I filed an application before the said court for setting aside the said decree. At that time my brothers cried and appologies me and forced me to withdraw the said application and promised to give the land and flat.He told my father to transfer the said land and flat in my name . But as soon as the suo motu inquiry by High Court in this matter was stoped, time to time they forced me to sign on such illegal documents which says that I have no objection in the land being transferred in the name of Vijay Shah & Seema Shah otherwise they would not give me said backside land and flat. For years and years they made me to run in talathi office,circle office,Tahsildar office,Prant office for it. But again my brothers backout from their promise and obtained the affidavit from my father on 2.1.2014 that he does not want to give any land to me. Hence I asked my brothers to give me back my land. But he shows his helplessness. Hence being continiously cheated ,I lodged a complaint against builder Vijay Shah & Seema at Dahanu Police Station who made a forged documents of revenue record of my land and cheated to Govt. Of Maharashtra by avoiding stamp duty ,& fraud upon the court. But being very influencive person , police has refused to register my genuine complaint. Even the JMFC court has refused and shown disrespect to the Hon’ble Supreme Court which states that to register a complaint by police is mandatory. The Civil Court at Dahanu has denied to here my case on merit best reason known to it. Even Cr.W.P.No.2037/2014 filed by me before the Hon’ble High Court,Mumbai , it was dispossed off without hearing me which compelled me to protest my right to be heard by fasting before the said court. It is pertenant to note that my brothers and their advocates ,revenue department & police have not filed any reply to the said petition. Vijay Shah & Seema Shah has not served me the copy of affidavit dt. 10.6.2014 filed by them before the said court so that his falsity should not come before the court. Thus running from pillar to post for years & years & lost not only wealth but health in toto and all teeth, gives me a feeling that justice is denied to common people and compelling me to think to end the life before the court so that people of country and corrupt officers should know the huge harassment to common people ,and their violation of human rights by the huge corruption in judiciary. I request to all highest authorities of our country to look into this matter & do justice to me before I comelled to take drastic steps. I shall be gratefully obliged for this act of kindness.
