From https://facebook/auan.almanzora?fref=ts NEW ROUND TABLE IN THE BAR ASSOCIATION - the demolition of houses via criminal proceedings After the success of the last round table which took place in the Bar Association of Almeria on the 28th October, which was attended by some 200 people, we advise you of new round table organised by this Bar Association in conjunction with the Official Association of Architects in Almeria. It will take place next Tuesday 11th November at 18.00 in the Auditorium of the Association, situated in C/Alvarez de Castro 25, Bajo, in Almeria, and is open to the public. This new round table addresses the demolition of houses via the criminal courts. It will be moderated by the Dean of Bar Association of Almeria, Don José Pascual Pozo Gómez, and counts on the presence of Doña Lourdes Molina Romero, President of the District Court in Almeria, Don Antonio Pérez Gallegos, Chief Prosecutor for the province of Almeria, Don Luis Miguel Columna Herrera, Chief Magistrate-Judge of Almeria, Don Javier Hidalgo Martínez, Dean of the College of Architects of Almeria, Gerardo Vazquez, lawyer and representative of the associations that fight against urban abuses in Almeria and Malaga known as AUAN and SOHA, Antonio Ramón Salas Rodríguez, President de la Mancomunidad de municipalities of the Valley of Almanzora, and Doña Eva Cano Pérez, secretary for the town hall of Albox and an expert in planning matters. Asked about the round table, Gerardo Vazquez said ‘ the efforts of the Bar Association and the Architects Association to focus on this issue is acknowledged and especially the effort and dedication of the Dean José Pascual Pozo Gómez. In the previous round table it was evident that the message that a solution must be found to these issues had permeated to the offices in Seville. Now, in this new round table I will try to deliver a similar message, this time at the level of the State with regard to the Criminal Code, that is to say I am going to speak about the necessity for a change in this Code, and about the social and economic damage caused by the demolition of houses of purchasers in good faith without a guarantee of fair and effective compensation. As I will try to explain, in the case of planning crimes, currently it is the victim who pays the highest penalty. The victim who purchased in good faith, may be, and indeed has been, in the position of having their house demolished and left without money and no home, whilst the promoter responsible for the crime is usually found to be insolvent and usually only fined a few thousand euros. The associations that I advise and I personally believe, that is fundamentally unjust as I will explain in the round table’. Asked about the point of view of the associations the Dean , Don José Pascual Pozo Gómez, said ‘This is what we will discuss. The position of Sr. Vazquez is known and I believe that it will be very interesting to listen to what the rest of the participants will have to say about this. I believe that this exercise of dialogue and exchange of ideas is good and fruitful, and I hope that will serve as another small step towards providing solutions to these houses’.
