No animal should be living outside on a chain The Lexus Project released this on Wednesday: PRESS RELEASE SUFFOLK COUNTY, NY Mahatma Gandhi said The greatness of a nation and its moral progress can be judged by the way its animals are treated. It is a sorry commentary upon our society when those charged with enforcing our laws choose to put their own self interests before the law and ignore their legal and moral duties and obligations, and the end result is that, to the extent we accept this, we are all diminished. In fighting for the welfare of animals there are numerous failings and inadequacies in our laws, and the legislatures that enact them. But, on the issue of animal cruelty, the NY State Legislature got it right when it enacted Section 371 of the Agriculture and Markets Law which unequivocally requires that: § 371. Powers of peace officers A constable or police officer must, and any agent or officer of any duly incorporated society for the prevention of cruelty to animals may issue an appearance ticket Section 371 of the Agriculture and Markets Law pursuant to section 150.20 of the criminal procedure law, summon or arrest, and bring before a court or magistrate having jurisdiction, any person offending against any of the provisions of article twenty-six of the agriculture and markets law. Unfortunately, it seems that, until they are brought to task by Court and the press, our police, and the law enforcement officials that oversee them, either lack the ability to read and comprehend the meaning of the word must or have simply decided they are above the law and can ignore it with impunity. This lack of respect for the law by the police is made even worse by a District Attorney who has remained suspiciously silent and uninvolved and an Attorney General who, while announcing sweeping initiatives against animal abuse, sits idly by while defending Police inaction. Luckily, the Appellate Division of the Supreme Court has already ruled, in the case of Jurnove v. Lawrence, that concerned citizens have the right to petition the Courts.to order the police to obey the law. Richard Rosenthal, the general counsel of The Lexus Project, having successfully sued to force the State Police to comply with Section 371 of the Agriculture and Markets Law in the Sprakers Flat Creek Border Collie case, has agreed to file suit against the Suffolk County Police Department in order to stop the needless suffering and death of the countless abused dogs they are refusing to protect. It is truly a pathetic comment on the quality of the Suffolk County Police Department that it will require a Supreme Court order to make them perform the duties and enforce the laws they are generously paid to do. It is truly terrifying that the motto of the Suffolk County Police Department has apparently changed from To protect and serve to We dont want to get involved
