Box 469-40300, HOMABAY Email: awiti.cyprian@gmail Dear Sir, RE: RESIGNATION FROM THE POST OF CHAIRMAN, HOMABAY PUBLIC SERVICE BOARD, WITH EFFECT FROM 10TH AUGUST, 2014 _____________________________________________ ______________________ I refer to the above, and hereby tender to you my resignation as the Chairman of Homabay County Public Service Board, with effect from the 10th August, 2014. The reasons for my resignation are as follows:- 1. Lack of Support from your Office a) My Appointment Following my appointment on the 16th July, 2013, I embarked on my work together with the other Board Members, with a view to delivering on our mandate and fulfilling the pledges that you had made to the people of Homabay County. You will recall that as the Chairman of your Campaign Team, we had identified several issues that would guide us in the delivery of services to the people. These were in accordance with the Constitution and all the other laws and the County Governments Acts, 2012. b) My 1st Board Meeting In my 1st Board Meeting I informed the Board that they should discharge their mandate in accordance with the Constitution, all the relevant laws and the County Governments Act. I promised the Board that we would be guided by the rule of law in all our deliberations and that the Board would act openly and fairly to everybody in the County. c) Your letters dated 16th July, 2013 On the same day of my appointment, you wrote to me and asked me to confirm various persons, in their employment, notwithstanding the fact that these people had not been interviewed and subjected to public vetting. Further, these positions had not been public advertised, to meet the requirements of the Constitution and the County Governments Act. The Board deliberated on your request at length on various occasions and recommended to you in writing that all the positions in issue should be advertised to attract as many candidates as possible and also with a view to giving everybody in the County a chance to compete for these posts. You are aware that you rejected this and proceeded to retain these people and continued to employ others, without the involvement of the Board. In writing to me your above letter, you showed disrespect to me as the chairman of the Board and completely disregarded the promises of fairness to everybody in the delivery of services that I had spearheaded as the Chairman of your Campaign Team. By refusing to give the Board a chance to fulfill its mandate, albeit in consultation with your office, you rendered the operation of the Board worthless and of no effect. d) The Subsequent Events i) You subsequently engaged and spearheaded a campaign against me, accusing me of all manner of ills. You labeled me a foreigner in the County, a lone ranger, a difficult person and specifically that I had refused to work with you. You forgot the tremendous role and sacrifices that I and several others had played towards your success and eventual inauguration as the 1st Governor of the County of Homabay. ii) There were efforts by many others and the Clergy from the County to reconcile the two of us. These efforts were reduced to nothing, when despite several meetings and finally meetings at Kisumu, you refused to implement an Agreement that we had signed. 2. The Attack On Myself at the Board Offices, in March, 2014 a) Early this year, I was summoned by the Homabay County Assembly to address them on various issues that they had raised with the County Public Service Board. No sooner had I entered my office in the morning, than a hoard of people descended on the offices of the Board, looking for me, and openly stating that they had been sent by your office to kill me. These people were financed and funded by your own office with the sole aim of killing me. b) It took the efforts of very Senior Officers from the Police Headquarters, the Provincial Police Office and members of the County Assembly to organize and rescue me from the attack, which had been coordinated and organized by officers from your own office. These happening were well documented and led to the arrest and prosecution of some people who pleaded guilty to the charges that were proffered against them. c) I proceeded to address the members of the County Assembly and explained to them in detail the attack on me, the reasons why that happened and the fact that the attack had been organized by your own office. I also informed them that my Security in the Town, was not guaranteed and I would continue to discharge my duties only with the consideration of my own security. d) Despite of and in the face of the above incident, you have kept quiet and todate you have never commented about it. As a family friend, my own friend, my Governor, you have never called me to express any sympathies or regrets at what happened. You have remained quiet oblivious of the fact that my own life was at stake. I was attacked in a public office during daylight and very next to your own office. Neither you nor any of your officers has ever called me or given an explanation as to why I had to be killed or eliminated. e) Following the above incident, you have not instituted any investigation into the matter. This was a grisly incident that required you to do more than just keep quiet. Notwithstanding that I was a Senior Public Servant in your administration, I am also a longtime family friend and was the Chairman of your Campaign Team. Once more you showed me your total lack of concern for my own life and disinterest in the loss that my family would have suffered had these people succeeded in killing me. You were oblivious of the long family relationship that my father and your father had built, that culminated into my father becoming your “baptismal father” in the Catholic Church/ Community. In the words and eyes of the Church and the people and in the eyes of God, both me and you became and have always been and called each other “Godbrother”. 3. My Unwavering Support for you. a) As your Campaign Chairman I stoidly steered the Committee, with the sole aim of delivering the Governorship to you. This I did with total commitment, both financially, materially and with unquestioned commitment to you as my Godbrother. I fended off any and all criticism against you from all quarters and stood by you until we achieved our final goal. b) I stood firmly for you when your opponent had a plan to steal your victory and announce fake results at Rongo. I led a gregarious effort to defeat the plan, which succeeded. c) When your opponent questioned your academic qualifications, I flew to the United Kingdom with my own funds and proceeded to Manchester University where I had your certificate authenticated by the University Registrar and subsequently emailed these to you, in time to allow the party to approve your academic qualification. d) When your opponent filed a Case to nullify your nomination by the ODM Party, I sat up in my apartment in the United Kingdom, and prepared the Court papers at night and dictated the Affidavit in response to the Petition by your opponent, which led to you winning the Petition against you. e) I poured in substantial financial resources, time, material resources to your Campaign without thinking or asking for anything from you. During the campaigns, my own rural house became the Campaign Headquarters, where you met with the Campaign Team and planned the strategies. f) In all the above endeavors and efforts, I never asked for any reward from you. I refused your gesture to take up any post at the County. I specifically informed you that I was running a busy law practice and had other investments in Nairobi that could not permit me to take up a full time job in the County. You are aware that I only accepted the post of the Chairman of the Public Service Board on a part time basis, to help you set up your administration, and only at your own insistence. On two previous occasions I had totally refused to takeup this post. 4. Withdrawal of Case I withdrew the Petition I had filed, wholeheartedly in the interest of peace and to promote reconciliation amongst all the parties. Having empathized with you during the demise of your brother and you welcoming me in your home, I was of the view that it would be unnecessary to continue with the Case. This I still confirm to you and I have no further reservations in this matter. It is over. 5. The Continued Orchestration of Hatred Towards Me by Your Office a) Despite all the above, members of your office have engaged in an orchestrated campaign against me. They have caused pamphlets and other unauthorized documents to be circulated against my person with the sole aim of demeaning me and my reputation in the County. I have complained to you personally about this and no action has been taken by you to stop this. b) You are aware that I have built a solid and successful career for a period of over thirty (30) years in my profession. It was because of my success as a professional, and as a member of society that I was chosen to lead your Campaign Team, and together with the other Team Members we succeeded in you being elected as the Governor of Homabay County. c) During my vetting at the County Assembly I pledged to the Assembly that I would carry out my duties by following the rule of law and always having the Constitution and the relevant laws as my guide. I also promised to consult with all the relevant authorities in the discharge of my duties. I have talked with you and consulted widely on various issues during the period I have been the Chairman of the Homabay County Public Service Board. Conclusion I believe that in the light of all the above, it is quite clear and in order that I tender my resignation with effect from today. I hope that my resignation will give you an unlimited opportunity to continue carrying out your mandate as the Governor of the County of Homabay. I do not want to stand in front of you in any way whatsoever, whether rightly or wrongly in the discharge of your duties. I will still remain true to my beliefs and calling as a professional without succumbing to any intimidation from any source. I wish you and your family well and believe that I will still find an opportunity in future to serve the County, God willing, in any other capacity. May God bless you.
